COMPLAINT
The Plaintiff, HOSPITALITY SIGN COMPANY, by its attorneys, KODAK & IMBLUM,
P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of
$10,514.73 (TEN THOUSAND FIVE HUNDRED FOURTEEN DOLLARS AND SEVENTY-
THREE CENTS), along with interest thereon at the statutory rate from May 17, 2009, upon
a cause of action of which the following is a statement:
1. The Plaintiff, HOSPITALITY SIGN COMPANY, is a corporation organized and
existing under the laws of the State of Tennessee, having its principal office and
place of business at 2156 Amnicola Highway, Chattanooga, Tennessee 37406.
2. The Defendant, INSITE DEVELOPMENT, LLC d/b/a COMFORT SUITE
MECHANICSBURG, is a corporation having its principal office and place of
business at 2055 TECHNOLOGY PARKWAY, MECHANICSBURG,
CUMBERLAND COUNTY, PENNSYLVANIA 17055.

3. Defendant, INSITE DEVELOPMENT, LLC D/B/A COMFORT SUITE
MECHANICSBURG, is a corporation organized and existing under the laws of the
Commonwealth of Pennsylvania, as more fully set forth on the Pennsylvania
Department of State Corporation Bureau print out attached hereto, marked Exhibit
"A" and made a part hereof.
4. On the dates, in the amounts, and for the prices set forth in a true and correct copy
of the Plaintiff's Invoice hereto attached, marked Exhibit "B" and made a part
hereof, Plaintiff, at the special instance request of the Defendant(s), sold and
delivered goods, wares and merchandise of the kind and description set forth on
said Exhibit and/or performed labor and provided services of the kind and
description set forth on said Exhibit to the total amount of TEN THOUSAND FIVE
HUNDRED FOURTEEN DOLLARS AND SEVENTY-THREE CENTS ($10,514.73).
5. The prices charged for said goods, wares and merchandise and/or labor performed
or services provided, were just and reasonable, were the legal and market prices
therefor and were the prices which the Defendant(s) promised and agreed to pay
to Plaintiff.

6. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature
of same and have previously been provided to Defendant(s).
7. Plaintiff frequently demanded payment from Defendant(s) of said amount due and
owing as aforesaid, but Defendant(s) refused and neglected and still refuse(s) and
neglect(s) to pay said amount or any part thereof.
WHEREFORE, Plaintiff brings this suitto recover from Defendant(s) the sum of TEN
THOUSAND FIVE HUNDRED FOURTEEN DOLLARS AND SEVENTY-THREE CENTS
($10,514.73), together with interest as set forth herein.

Defendant, Insite Development, LLC d/b/a Comfort Suite Mechanicsburg, by and
through its counsel, Cunningham & Chernicoff, P.C., files its Answer to Plaintiffs Complaint
and in support thereof avers as follows:
1. Admitted upon belief.
2. Admitted.
3. Admitted.
4. This allegation refers to a writing which is the best evidence of concerning the
subject of such an averment.
5. This allegation is a conclusion of law to which no response is required. To the
extent that a response is judicially deemed to be required, it is specifically denied.
6. Admitted.
7. Admitted in part and denied in part. It is admitted that Plaintiff has demanded
payment from Defendant. The proper amount due from Defendant to Plaintiff, if
any, is a conclusion of law to which no response is required. To the extent that a
response is judicially deemed to be required, it is specifically denied. By way of
further answer, Defendant believes, and therefore avers, that all payments made to
date may not have been properly credited and a strict accounting of all payment
made and applied is hereby demanded, if relevant, at the time of trial.
WHEREFORE, Defendant, Insite Development, LLC d/b/a Comfort Suite
Mechanicsburg, hereby respectfully requests this Honorable Court dismiss Plaintiffs Complaint
with prejudice and grant Defendant such further reliefs is just and proper.
