NOTICE UNDER THE FAIR DEBT COLLECTION PRACTICES ACT,
15 U.S.U. §1601 (AS AMENDED)
THE PENNSYLVANIA UNFAIR TRADE PRACTICES ACT
AND CONSUMER PROTECTION LAW,
73 PA.CON.STAT.ANN.§201, ET. SEQ. ("THE ACTS")
IN AS MUCH AS THE ACTS MAY APPLY, PLEASE BE ADVISED
THAT THIS COMMUNICATION IS FROM A DEBT COLLECTOR.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY
INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
The Plaintiff, State Farm Fire and Casualty Company, by its attorney Paul F.
D'Emilio, Esquire, bring this action upon a cause whereof the following is a statement:
1. The Plaintiff, State Farm Fire and Casualty Company, ("Plaintiff') is a
Corporation authorized to do business in the Commonwealth of Pennsylvania, with a
address of 112 E. Washington Street, DTB 8, Bloomington, IL 61701.
Plaintiff brings this action as subrogee of John D. Levandowski, herein the
("Insured") under a policy of insurance issued by Plaintiff.
2. Defendant, Alan H. Hartman, is an individual currently residing at SCI Camp Hill,
2500 Lisburn Road, Camp Hill, PA 17001.
3. On or about February 5, 2007 Defendant intentionally set Plaintiffs Insured's
vehicle on fire at 3527 Penn Avenue, Sinking Spring, PA 19608, the water from the Fire
Company attempting to put the fire out ran down the driveway and into Plaintiffs
Insured's property causing damage to the carpet, front door and screen.
4. Plaintiff avers that the personal property of the Insured was damaged as a result
of the occurrence hereinbefore mentioned, the reasonable costs of repairs thereto
being is Two Thousand Eighty and 68/100 ($2,080.68) Dollars. A true and correct
copy of the estimate is attached hereto, made a part hereof and marked Exhibit "A."
5. On or about July 16, 2007 the Common Pleas Court of Berks County entered
an order wherein and whereby Defendant Alan H. Hartman is required to pay restitution
to Plaintiff and Defendant has failed to comply.

Intentional Acts
6. Plaintiff, incorporates by reference all of the allegations contained in paragraphs
1 through 5 inclusive of this Complaint as fully as though same were herein and set
forth at length.
7. At all times herein mentioned, Defendant acted intentionally, consciously,
deliberately and with malice toward Plaintiffs insured.
8. At all times herein mentioned, Defendant intentionally, carelessly, and
recklessly.
9. As a direct and proximate result of the conduct of the Defendant Plaintiffs
insured sustained damages and incurred the above expenses.

State Farm Fire and Casualty Company v. Alan H. Hartman
Negligence
10. Plaintiff, incorporates by reference all of the allegations contained in paragraphs
1 through 9 inclusive of this Complaint as fully as though same were herein and set
forth at length.
11. The said occurrence was due to the negligence of the Defendant in that he:
a. intentionally set Plaintiff's Insured's vehicle on fire;
b. intentionally caused damage to Plaintiff's Insured property;
C. acted intentionally, consciously, deliberately and with malice toward
Plaintiffs insured; and
d. did violate the various statutes and laws of the County of Berks,
and Commonwealth of Pennsylvania sections 18§ 3301, 2702, 2705, 3503, 5503, and
5104.
12. As a direct and proximate result of the conduct of the Defendant Plaintiffs
Insured sustained damages and incurred the above loss.
WHEREFORE, Plaintiff demands judgment against the Defendant upon each
court in an amount not in excess of Fifty Thousand and 00/100 ($50,000.00) dollars
together with costs of suit.

The estimate you received from us details the depreciation applied to your loss. If you cannot have the
repairs completed for the repair/replacement cost amount estimated, please contact your claim
representative prior to beginning repairs.
The terms and conditions of your Homeowner's insurance policy provide for certain building

the date of loss; and
2. Notify us within 30 days after the work has been completed.
3. Confirm completion of repair or replacement, by submitting invoices, receipts or other
documentation to your Agent or claim office.
All policy provisions apply to your claim.
Any person who knowingly and with intent to defraud any insurance company or other person files an
application for insurance or a statement of claim containing any materially false information or conceals
for the purpose of misleading, information concerning any faot material thereto commits a fraudulent
insurance act, which is a crime, and subjects such person to criminal and civil penalties.
