' Reed and Tern-Lynn Coleman, co-executors and residuary beneficiaries of the Estate of Maudie Cordelia Coons, Deceased. WHEREAS, Maudie Cordelia Coons, died on November 13, 2009, having executed a Last Will and Testament, dated October 26, 2004; and, WHEREAS, under the provisions of the aforesaid Last Will and Testament, Lynn L. Reed and Terri-Lynn Coleman, were designated as co-executors of the Estate; and, WHEREAS, on November 19, 2007, the Register of Wills in and for Cumberland County, Pennsylvania did constitute and appoint Lynn L. Reed and Terri-Lynn Coleman as co- executors of the Estate of Maudie Cordelia Coons, filed to Estate Number 21-07-1055; and, WHEREAS, under the terms and provisions of Paragraph 3, Section A of the Last Will and Testament of Maudie Cordelia Coons, the following bequest was made: To Terri-Lynn Coleman, all real property and the personal property located upon that real property, owned by the Decedent at the time of her death. WHEREAS, under the terms and provisions of Paragraph 3, Section B of the Last Will and Testament of Maudie Cordelia Coons, the following bequests were made: Family Settlement Agreement and Final Releases Estate of Maudie Cordelia Coons File No. 21-07-1055 Page 1 of 5 ~~ ;; l~ To Samuel L. Stine: $2,000.00 To Kenneth L. Stine: $2,000.00 To William L. Stine: $2,000.00 To SueAnn Masser: $5,000.00 To Jerry L. Miller: $2,000.00 To Shelly Jean Wetzel: $2,000.00 To the Estate of Pauline Wurfl: $3,000.00 WHEREAS, there is no Paragraph 3, Section C of the Last Will and Testament of Maudie Cordelia Coons; and, WHEREAS, under the terms and provisions of Paragraph 3, Section D of the Last Will and Testament of Maudie Cordelia Coons, the following bequests were made: To Terri-Lynn Coleman, seventy-five percent (75%) of the residual estate; and to Lynn L. Reed, twenty-five percent (25%) of the residual estate. WHEREAS, the co-executors have proceeded with the administration of the Estate consisting of the assets set forth in the First and Final Accounting, a true and correct copy of which is filed herewith; and, WHEREAS, the only parties remaining in interest in the Estate aze the above-named parties; and, WHEREAS, the parties desire that the parties desire that the co-executors shall not be required to file an Account with the Register of Wi11s of Cumberland County and the net estate of the Decedent be distributed without the necessity of filing a formal account to avoid expense, delay and publicity of a formal accounting, but should intead be distributed in accordance with the schedule of proposed distribution in the First and Final Accounting filed herewith; NOW THEREFORE, in consideration of the mutual promises, covenants and agreements recited herein, and intending to be legally bound hereby, Lynn L. Reed and Tern-Lynn Coleman, Family Settlement Agreement and Final Releases Estate of Maudie Cordelia Coons, File No. 21-07-1055 Page 2 of 5 the residuary beneficiaries of the Estate of Maudie Cordelia Coons, do hereby formally agree as follows: 1. Each has fully and carefully reviewed the First and Final Accounting, including the schedule of distribution of the co-executors, Lynn L. Reed and Terri-Lynn Coleman for the Estate of Maudie Cordelia Coons; each finds them to be true and correct and acceptable; and each acknowledges that he or she has received a copy of this Family Settlement Agreement and the Final Releases. 2. In order to avoid expense, delay and publicity involved in the filing of a formal Account and Schedule of Distribution, no account to the Court is necessary and each does hereby agree and consent to the distribution being made with filing a First and Final Account and Schedule of Proposed Distribution, the same to be with the force and effect as if they had been fled and confirmed by the Court of Common Please of Cumberland County, Pennsylvania. 3. Each does hereby release, remise, quitclaim and forever discharge the Estate of Maudie Cordelia Coons, and the co-executors, Lynn L. Reed and Terri-Lynn Coleman, the heirs, devisees, executors, administrators, and assigns, from all manner of acts, suits, claims, accountings, debts and demands whatsoever which they, their heirs and assigns, may at any time hereafter have against said co-executors, the Estate or the assets of the Estate. 4. Lynn L. Reed and Terri-Lynn Coleman do hereby covenant and agree that they will contribute their share of the Estate to satisfy and claims, debts, demands, suits, or causes of action which maybe successfully brought against the Estate or the co-executors after the execution of the Family Settlement Agreement and Final Release. 5. The parties hereto agree that they will at all times in the future and wherever Family Settlement Agreement and Final Releases Estate of Maudie Cordelia Coons, File No. 21-07-1055 Page 3 of 5 necessary, appropriate or convenient, make, execute and deliver to the co-executors or as otherwise directed by the co-executors, any and all instruments, documents, conveyances, deeds, releases or other instruments of any kind necessary or convenient to carry out the intentions of this Family Settlement Agreement and Final Release. 6. 'The parties hereto agree that this Family Settlement Agreement and Final Release constitutes the entire understanding among the parties hereto and no other representations or statements of any kind, written or oral, have been made to them by the co-executors or any other person or party on their behalf. 7. This Family Settlement Agreement and Final Release shall inure to the benefit of and shall be binding upon the parties hereto, each of them, their heirs, executors, administrators, successors and assigns. 8. This Family Settlement Agreement and Final Release shall be governed by the laws of the Commonwealth of Pennsylvania.
