Pursuant to the authority contained in the warrant of attorney set forth in the credit
application attached as Exhibit "A" of the Complaint filed in this action, I appear for the
Defendants, SHENK ATHLETIC EQUIPMENT CO., O. PHILIP SHENK a/k/a OWEN P.
SHENK, MICHAEL SHENK and JUDITH SHENK, and confess judgment in favor of
Plaintiff and against the Defendants as follows:

Interest at 18% per annum

COMPLAINT FOR CONFESSION OF JUDGMENT FOR
MONEY UNDER RULE 2951(b)
Plaintiff files this civil action pursuant to Pennsylvania Rule of Civil Procedure 2951
(b) for judgment by confession and avers the following:
1. The Plaintiff, BODEK AND RHODES, INC., is located at 2951 Grant Avenue,
Philadelphia PA 19114.
2. The Defendant, SHENK ATHLETIC EQUIPMENT CO., is a Pennsylvania
corporation with a last known address at 5010 East Trindle Road, Mechanicsburg, PA
17055.
3. The Defendant, O. PHILIP SHENK a/k/a OWEN P. SHENK, is an adult individual
with a last known address of 5010 East Trindle Road, Mechanicsburg, PA 17055.
4. The Defendant, MICHAEL SHENK, is an adult individual with a last known
address of 5010 East Trindle Road, Mechanicsburg, PA 17055.
5. The Defendant, JUDITH SHENK, is an adult individual, with a last known
address at 5010 East Trindle Road, Mechanicsburg PA 17055.
6. On or about March 9, 2000, Defendants, for good and valuable consideration
received, executed and delivered to Plaintiff a written credit application, a true and correct
copy of which is attached hereto, made a part hereof and marked Exhibit "A".
7. Pursuant to the credit application, Defendants agreed to make timely monthly
payments to Plaintiff.
8. Defendants have failed to make timely payments to Plaintiff under the credit
application.
9. Defendants are currently in default of the credit application by virtue of their
failure to make timely payments to Plaintiff under the credit application.
10. As a consequence of the foregoing default, Defendants are indebted to Plaintiff
in the following amount:
Principal $23,393.51
Interest at 18% per annum
from July 1, 2009 $4,660.76
Attorneys fees $5.486.51
TOTAL $33,540.78
11. Pursuant to the terms and provisions of the credit application, Plaintiff
exercises its option to confess judgment for the entire sum of money which may be due or
become due under the attached credit application.
12. The attached credit application has not been assigned by Plaintiff.
13. Judgment has not been entered on the attached credit application in any
jurisdiction.
14. Judgment is not being entered against a natural person in connection with a
consumer credit transaction.
WHEREFORE, Plaintiff demands judgment against Defendants in the sum of
$33,540.78, plus costs as authorized by the warrant of attorney provisions of the
attached Note.
