The Plaintiffs, Timothy C. Powell and Cathy L. Powell, are husband and wife who reside at 343 Kerrsville Road, Carlisle, Cumberland County, Pennsylvania 17015. 2. Defendants John O. Brownawell a/k/a James O. Brownawell, and Marjorie C. Brownawell a/k/a Marjorie L. Brownawell, while married, were the owners of a tract of land in Penn Township, Cumberland County, Pennsylvania, which is the subject of this quiet title action. Defendants were divorced on April 5, 1967. 3. Defendant John O. Brownawell a/k/a James O. Brownawell's last known address was 4033 Rawleigh Street, Harrisburg, Dauphin County, Pennsylvania, as of February 11, 1991, and as reflected in deeds recorded in the Office of the Recorder of Deeds in and for Cumberland County at Deed Book C, Volume 35, Pages 1163 and 1198. 4. Defendant Marjorie C. Brownawell a/k/a Marjorie L. Brownawell later remarried and became Marjorie L. Beaston. Her last known address was 1422 Spring Road, Carlisle, Pennsylvania, as of July 28, 1986, and as reflected in a deed recorded in the Office of the Recorder of Deeds in and for Cumberland County at Deed Book B, Volume 32, Page 342. 5. Defendants' present whereabouts are unknown. Furthermore, the Plaintiffs have no knowledge or information as to the whereabouts of the Defendants' heirs, devisees, administrators, executors, successors and assigns, nor of any other unknown persons having or claiming any right, title, estate, lien, or interest through or under the named Defendants or in their own right. 6. Plaintiffs are the owners of a tract of land in Penn Township, Cumberland County, Pennsylvania, which was acquired by deed of William J. Thompson and Betty J. Thompson, husband and wife, to Timothy C. Powell and Cathy L. Powell, husband and wife, dated August 18, 2004, recorded August 18, 2004 at Deed Book 264, Page 3744, said premises are described as follows: ALL THAT CERTAIN tract of land situate in Penn Township, Cumberland County, Pennsylvania, described in accordance with a survey prepared for William J. Thompson by Byers and Runyon Surveying dated February 24, 1992 and more particularly bounded and described as follows: BEGINNING at an existing iron pin in the northeast corner of land now or formerly of Charles R. Figard and in the line of lands now or formerly of Joseph Widders; thence along the lands now or formerly of Widders North 79 degrees 1 minute 26 seconds East 709.94 feet to an existing stone pile which is in the southwest corner of lands now or formerly of Clark A. Rhoads; thence along the lands now or formerly of Rhoads North 78 degrees 24 minutes 7 seconds East 336.65 feet to an existing stake and stones in the southwest corner of lands now or formerly of Lawrence V. Hoffman; thence along the lands now or formerly of Hoffman North 78 degrees 10 minutes 20 seconds East 501.11 feet to an existing stake at stones in the southwest corner of lands now or formerly of Earl E. Hoffman; thence along the lands now or formerly of Hoffinan North 78 degrees 58 minutes 34 seconds East 432.31 feet to an iron pin in the northwest corner of lands now or formerly of Babe Eshelman; thence along the lands now or formerly of Eshelman South 20 degrees 40 minutes 51 seconds East 381.40 feet to a rebar in the line of lands now or formerly of Larry L. Warner; thence along the lands now or formerly of Warner South 77 degrees 54 minutes 20 seconds West 284.70 feet to an existing iron pin in the northeast corner of lands now or formerly of Carl H. Byers; thence along the land now or formerly of Byers South 73 degrees 31 minutes 13 seconds West 812.65 feet to an existing stone pile in the northeast corner of lands now or formerly of Janet S. Houston and Betty L. Rice; thence along the lands now or formerly of Houston and Rice South 76 degrees 42 minutes 06 seconds West 868.51 feet to a existing stone pile in the line of lands now or formerly of Figard; thence along the lands now or formerly of Figard North 20 degrees 40 minutes 51 seconds West 490.22 feet to an existing iron pin at the place of BEGINNING. CONTAINING 19.6825 acres. UNDER AND SUBJECT to existing covenants, agreements, conditions, easements, restrictions and rights of record, to the extent valid and enforceable and still applicable to the above described premises. BEING the same premises which William J. Thompson and Betty J. Thompson, husband and wife, of Carlisle, Cumberland County, Pennsylvania by their Deed dated August 18, 2004 and recorded in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 264, Page 3744 granted and conveyed unto Timothy C. Powell and Cathy L. Powell, husband and wife, Grantors herein. 7. The Plaintiffs bring this action pursuant to Pa. R. Civ. P. 1061(b)(1) - (4) providing, inter alia, that any action to quiet title may be brought to determine "any right, lien, title or interest in the land or determine the validity or discharge of any document, obligation or deed affecting a right, lien, title or interest in land." 8. Prior to the conveyance from William J. Thompson and Betty J. Thompson, the title to the property devolved as follows: A. Tax Claim Bureau of Cumberland County, Trustee for James O. Brownawell, reputed owner, to William J. Thompson and Betty J. Thompson, husband and wife, by tax claim bureau deed dated January 26, 1967 and recorded January 26, 1967, in Deed Book F, Volume 22, Page 703. A true and correct copy of this deed is attached hereto as Exhibit "A". B. Harry Beecher, Administrator CTA under the Last Will and Testament of Ellie W. Long, to John O. Brownawell and Marjorie C. Brownawell, husband and wife, by deed dated September 24, 1960 and recorded November 12, 1960, in Deed Book B, Volume 20, Page 142. A true and correct copy of this deed is attached hereto as Exhibit "B". C. John L. Rupert, Administrator of the Estate of Henry E. Rupert, to Elmer J. Long, by deed dated March 27, 1909 and recorded November 12, 1960, in Deed Book B, Volume 20, Page 139. A copy of this deed is attached hereto as Exhibit "C". D. H. R. Lefever and D.L. Lefever, Assignees for the Benefit of David Lefever, to H. E. Rupert, by deed dated April 8, 1889 and recorded November 12, 1960, in Deed Book B, Volume 20, Page 135. A copy of this deed is attached hereto as Exhibit "D". E. Ethel Walker and Harvey S. Walker, husband and wife, Elizabeth Hoffner and Russell L. Hoffner, husband and wife, Harold Newcomer and Grace Newcomer, husband and wife, Anna Commerer and Arthur Commerer, husband and wife, and Katherine Sprow and Monroe Sprow, husband and wife, all heirs of Elmer J. Long, deceased, by quitclaim dated March 24, 1960 and recorded April 16, 1960, in Deed Book T, Volume 19, Page 349, for the purpose of vesting all right, title and interest in the Estate of Ellie W. Long, deceased. A copy of this Quitclaim is attached hereto as Exhibit "E". F. David Lefever and Margaretta C. Lefever, husband and wife, to Henry R. Lefever and D. L. Lefever, for benefit of creditors of David Lefever, by deed dated May 9, 1887 and recorded May 9, 1887, in Deed Book C, Volume 4, Page 386. A copy of this deed is attached hereto as Exhibit "F". G. John J. Green and David McCullough, assignees for the Benefit of Creditors of David Lefever, to David Lefever, by deed dated March 13, 1855 and recorded October 8, 1869, in Deed Book A, Volume 3, Page 419. A copy of this deed is attached hereto as Exhibit "G". 9. The Tax Claim Bureau Deed stated in Paragraph 8A above incorrectly stated the reputed owner as "James O. Brownawell" and not John O. Brownawell and Marjorie C. Brownawell, as was reflected in the Cumberland County land records. 10. The Plaintiffs bring this quiet title action at this time to compel John O. Brownawell, a/k/a James O. Brownawell, Marjorie O. Brownawell, a/k/a Marjorie L. Brownawell, their heirs, devisees, administrators, executors, successors and assigns and any persons having or claiming a right, title, estate, lien or interest in the Premises to set forth the nature of their claims or be forever barred from making such claims. WHEREFORE, the Plaintiffs request this Court to decree the title to said property to be in the Plantiffs and to enjoin the Defendants from setting up any title to said premises or from impeaching, denying or in any way attacking the Plaintiff s title to said property.
