' Contractor WHEREAS, SCOTT A. SMITH and TAMATHA L. SMITH, husband and wife, currently residing at 1282 Timberview Drive, Mechanicsburg, Pennsylvania, hereinafter called "Owner," has or is about to execute an Agreement with W.R. STANSFIELD CONSTRUCTION, INC., a Pennsylvania corporation, with its principal office at 3672 Spring Road, Carlisle, Pennsylvania, hereinafter called Contractor, for the construction of a two-story single family residence having approximately _ _ square feet of floor area upon real estate situate in Hampden Township, Cumberland County, Pennsylvania, being more particularlY bounded and described as follows: ALL THAT certain tract of real estate situate in Hampden Township, Cumberland County, Pennsylvania, more specifically bounded and described as follows, to wit: BEGINNING at a concrete monument on the northern right-of-way line of Mountain View Road, South 64° 09' 24" East a distance of 30.96 feet to a point on the northern right-of-way line of Mountain View Road; THENCE by same by a curve to the left having a radius of 740.00 feet and a distance of 147.31 feet to a point on the northern right-of-way line of Mountain View Road; THENCE, by lands now or formerly of Walter L. and Jessie M. Kile, North 39° 35' 40" East a distance of 226.53 feet to an iron pin; THENCE by lands of same North 79° 12' 24" West a distance of 133.43 feet to an iron pin; THENCE by lands of same North 64° 09' 24" West a distance of 120.38 feet to an iron pin; THENCE, along the eastern boundary line of Lot No. 313,, on the Preliminary/Final Subdivision Plan for Walter L. Kile, South 20° 40' West a distance of 200.82 feet to a point, a concrete monument being the point and place of BEGINNING. Containing 0.984 acres more or less. BEING Lot No. 2 on a Preliminary/Final Subdivision Plan for Walter L. Kile dated April 7, 2000 and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book_ , Page _ _. BEING a part of the same premises which Joseph Novinger and Marion M. Novinger, husband and wife, by Deed dated May 27, 1949, and recorded in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book D, Volume 14, Page 406, granted and conveyed unto Walter L. Kile and Jessie M. Kile, husband and wife, Grantors herein. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the Agreement, for itself and its subcontractors, and all parties acting through or under Contractor and its subcontractors, covenant and agree that no mechan'cs 'liens or claims shall be flied or maintained by them or any of them against the above-described real estate or the single family residence, or on account of any work done or materials furnished by them or any of them under said Agreement or otherwise, for, towards, in, or about the completion of the two-story single and said Contractor, for itself, its family residence on the real estate above-described subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechan'c s liens or claims against the real estate above-described or the single family residence, and agree that this instrument, waiving the right of lien, shall be an independent covenant. ~ NOTARIAL SEAl. !
