HomeMy WebLinkAbout01-0115 S TIP ULA TION.4 G.4INS T LIENS THIS AGREEMENT made the (p~ day of flanuary, 2001, by and between after referred to as Contractor, and DAVID L. BAIL and SULIE ANN L. BAIL, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No. 75, Meadowbrook Farms Final Subdivision Plan, Phase II, Middlesex Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of the sum of(S1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or trader them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive amd relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. (D In wimess whereof, I hereunto set my hand and official seal. ~ My(~ommi,mtonl~l~maFeb. 7,~O04 / ' Member, Penn~vmnia Ammoetatlon ot Notaries ALL that certain tract of land situate in Middlesex Township, Cumberland County, Pennsylvania, being Lot No. 75, as shown on the Plan entitled Meadowbrook Farms Final Subdivision Plan Phase II dated February 12, 1999, last revised June 3, 1999 and recorded August 17, 1999, in Cumberland County Plan Book 79, Page 85, more particularly bounded and described as follows: BEGINNING at an iron pin, being a southerly comer of Lot No. 76, and lying in a northerly tight-of- way line of Mayfield Court cul-de-sac (60 feet radius); thence along said right-of-way, along a curve to the left, having a chord bearing of South 25 degrees 15 minutes 16 seconds West, a chord distance of 60.28 feet, a radius of 60.00 feet, and an arc distance of63.16 feet to an iron pin, lying along said right-of-way and being a northerly comer of Lot No. 74; thence along said Lot, South 85 degrees 05 minutes 56 seconds West, 195.32 feet to an iron pin, being a westerly comer of said Lot and lying in a northerly line of future Phase III; thence along said lands, North 44 degrees 54 minutes 41 seconds West, 82.55 feet to an iron pin, being a northerly comer of said lands and a southerly comer of Lot No. 62; thence along said Lot, North 59 degrees 04 minutes 49 seconds East, 235.00 feet to an iron pin, being a common comer of Lot Nos. 61, 60 and 76; thence along Lot No.76, South 35 degrees 29 minutes 12 seconds East, 132.64 feet to an iron pin, being the place of BEGINNING. CONTAINING 0.661 acre. Lot No. 75 is subject to one-half of a 20-foot sanita~ sewer easement along its southerly boundary. EXHIBIT "A"
