Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO.~i-("'~'I MLD WHEREAS, HOLY SPIRIT CORPORATION, a Pennsylvania non-profit corporation with its principal office located at 503 North 21st Street, Camp Hill, Pennsylvania, hereinafter called "Owner," has or is about to execute an Agreement with CUMBERLAND DESIGN & BUILDING COMPANY, INC., a Pennsylvania corporation, with its principal office at Post and Claremont Roads, Carlisle, Pennsylvania, hereinafter called "Contractor," for the construction of a one-story office building having approximately 5,420 square feet of floor area and other improvements as shown on Land Development Plan for Holy Spidt Corporation Office Building, dated August 23, 2000, last revised November 16, 2000, recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Plan Book 82, Page 51, upon real estate situate in Hampden Township, Cumberland County, Pennsylvania, being more particularly bounded and described as follows: ALL THAT CERTAIN tract or parcel of land situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the northern dedicated right-of-way line of North Salem Church Road, at the southeast corner of Lot No. 20 on the hereinafter described Final Subdivision Plan; THENCE along the eastern line of said Lot No. 20 North 03 degrees 57 minutes 39 seconds East a distance of 221.31 feet to a point at the southwest corner of Lot No. 18 of Silver Creek Commerce Park, Phase 2; THENCE along the southern line of said Lot 18, South 85 degrees 31 minutes 53 seconds East a distance of 292.14 feet to a point on the western dedicated right- of-way line of Jaguar Drive; THENCE along the western dedicated right-of-way line of Jaguar Drive by a curve to the right, having a radius of 625.00 feet, an arc length of 228.20 feet to a point; THENCE along the northwestern dedicated right-of-way line of the intersection of Jaguar Drive and North Salem Church Road by a curve to the right having a radius of 42.00 feet, an arc length of 62.48 feet to a point on the northern dedicated right-of-way line of North Salem Church Road; THENCE along the northern dedicated right-of-way line of North Salem Church Road by a curve to the left having a radius of 690.48 feet, an arc length of 200.64 feet to a point at the southeast corner of Lot No. 20 on the hereinafter described Final Subdivision Plan, the point and place of BEGINNING. 005574-00057/1.9,01/RHW/KLT/142276.1 CONTAINING 1.48 acres, more or less. BEING Lot No. 19, Final Subdivision Plan (Lots #15, #19 & #20), Silver Creek Commerce Park - Phase I, dated November 18, 1997, last revised August 11, 1998, recorded in the Office of the Recorder of Deeds of Cumberland County, in Plan Book 77, Page 124. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the Agreement, for itself and its subcontractors, and all parties acting through or under Contractor and its subcontractors, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the above- described real estate for or on account of any work done or materials furnished by them or any of them under said Agreement or otherwise, for, towards, in, or about the completion of the office building and other improvements, as described above, on the real estate above described and said Contractor, for itself, its subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the real estate above described, and agree that this instrument, waiving the right of lien, shall be an independent covenant.
