PLAINTIFF'S MOTION TO STAY ALL RULES TO FILE A COMPLAINT AND FOR
LEAVE TO CONDUCT PRE-COMPLAINT DISCOVERY IN THE NATURE OF
INFORMATION AND DOCUMENT PRODUCTION
Plaintiff, by his attorneys, Villari, Brandes & Kline, P.C., respectfully requests this
Honorable Court to grant leave to Plaintiff to conduct pre-complaint discovery in the nature of
information and document production from certain parties or persons for the purpose of
obtaining facts and other information that will enable Plaintiff to draft a sufficient Complaint and
obtain Certificates of Merit in this action and to stay all Rules to File a Complaint in the above-
captioned action. In support thereof, Plaintiff asserts the following:
1. The aforenoted Civil Action results from dental care provided to Plaintiff,
Christopher Deluca, by the defendants, which Plaintiff alleges deviated from accepted standards,
and caused injury to Christopher Deluca.
2. Simultaneous with the filing of this Motion, Plaintiff initiated this action by filing a
Writ of Summons. A true and correct copy of the Writ of Summons is attached hereto as Exhibit
"A."
3. Due to the absence of the needed records, all of which are in the exclusive control of
defendants and their failure to provide same to Plaintiff, Plaintiff is unable to determine the merit
of their claim and, if meritorious, to draft a sufficient Complaint and file Certificates of Merit in
this action without conducting pre-complaint discovery.
4. A full and complete, legible, certified copy of the entire dental chart (including any
and all paper records and records on computer) and all records pertaining to Christopher Deluca
is needed before any potential expert can reach sufficient opinions and conclusions to provide
appropriate Statements of Merit.
5. The records and information needed by Plaintiff are, upon information, in the
exclusive possession of the defendants.
6. Pursuant to Pennsylvania Rule of Civil Procedure 1042.3(a), in any case in which a
professional liability claim is asserted against a licensed professional, counsel for plaintiff must
file with the Complaint, or within sixty (60) days of filing the Complaint, a certificate
("Certificate of Merit") that an appropriate licensed professional has supplied a written statement
to plaintiff that there exists a reasonable probability that the care, skill or knowledge exercised or
exhibited in the treatment, practice or work that is the subject of the Complaint fell outside
acceptable professional standards and that such conduct was a cause in bringing about the harm.
7. According to Pa. R.C.P. 1042.3(b), a separate Certificate of Merit must be filed as to
each licensed professional against whom a claim is asserted.
8. In addition, Pa. R.C.P. 1042.5 provides that a plaintiff who has asserted a professional
liability claim may, without leave of court, request production of documents and things prior to
filing a certificate of merit.
9. More importantly, the note accompanying Pa. R.C.P. 1042.5 provides that "[u]pon
motion seeking leave of court [to conduct discovery], the court shall allow any discovery which
is required for a licensed professional to make a determination as to whether a defendant
deviated from accepted professional standards." See Note, Pa. R.C.P. 1042.5 (emphasis added).
10. Further, an amendment to the Rules of Civil Procedure provides a two-prong test for
pre-complaint discovery: (1) the information sought must be material and necessary to the filing
of the complaint, and (2) the discovery will not cause unreasonable annoyance, embarrassment,
oppression, burden or expense to any person or party. Pa. R.C.P. 4003.8 with Explanatory
Comment.
11. Plaintiff will be unfairly prejudiced without full and complete records and documents
that are needed to obtain complete expert review and to draft and serve a sufficient Complaint.
12. Further, Plaintiff's request will not cause unreasonably burden, annoyance,
embarrassment, oppression or expense.
13. Plaintiff requests leave to conduct pre-complaint discovery to obtain the information
and documents described in paragraph 4, above.
14. Plaintiff also requests that this Honorable Court stay all further proceedings including
but not limited to issuance and/or enforcement of any Rules to File a Complaint in this Civil
Action for a period sufficient to accomplish the aforenoted discovery required to assist Plaintiff
to determine if this claim is meritorious, and if meritorious, to draft and file a sufficient
Complaint, to obtain and file Certificates of Merit and to properly serve all defendants.
WHEREFORE, Plaintiff respectfully requests this Honorable Court enter the proposed
Order attached hereto.

I. STATEMENT OF FACTS

II. ARGUMENT
A. The Pennsylvania Rules of Civil Procedure Permit Plaintiff To Seek Pre-
Complaint Discovery To Obtain Certificates of Merit.
Pursuant to the Pennsylvania Rules of Civil Procedure 1042.3(a), in any case in which a
professional liability claim is asserted against a licensed professional, counsel for plaintiff must
file with the Complaint, or within sixty days of filing the Complaint, a Certificate of Merit. The
Certificate must state that an appropriate licensed professional has supplied a written statement
to plaintiff that there exists a reasonable probability that the care, skill or knowledge exercised or
exhibited in the treatment, practice or work that is the subject of the Complaint fell outside
acceptable professional standards and that such conduct was a cause in bringing about the harm.
Although the "appropriate licensed professional" need not be the expert who testifies at trial for
plaintiff, an appropriate licensed professional must possess sufficient education, training,
knowledge and experience that he could provide credible, competent testimony against the
defendant licensed professional. See Note to Pa. R.C.P. 1042.3 (a)(1). Moreover, Pa. R.C.P.
1042.3(b) provides that a separate certificate of merit must be filed as to each licensed
professional against whom a claim is asserted.
Pennsylvania Rules of Civil Procedure 1042.1(b) defines "licensed professionals" as
including a nurse and a "healthcare provider[s]" as further defined by Section 503 of the Medical
Care Availability and Reduction of Error (Mcare) Act, 40 P.S. § 1303.503. See Pa. R.C.P.
1042.1(b). Section 503 of the MCARE Act defines healthcare provider, in relevant part, as "A
primary health care center ... including a corporation, university or other educational institution
licensed or approved by the Commonwealth to provide health care or professional medical
services as a physician, a certified nurse midwife, a podiatrist, hospital, nursing home, birth
center, and an officer, employee or agent of any of them acting in the course and scope of
employment." See 40 P.S. § 1303.503.
Additionally, Pa. R.C.P. 1042.5 provides that a plaintiff who has asserted a professional
liability claim may, without leave of court, request production of documents and things prior to
filing a certificate of merit. More importantly, the note accompanying Pa. R.C.P. 1042.5
provides that "[u]pon motion seeking leave of court [to conduct discovery], the court shall allow
any discovery which is required for a licensed professional to make a determination as to
whether a defendant deviated from accepted professional standards." See Note, Pa. R.C.P.
1042.5 (emphasis added).
In the case at hand, Plaintiff will need to obtain a full and complete, legible, certified
copy of the entire dental chart (including any and all paper records and records on computer),
billing records pertaining to Plaintiffs care atiby Dr. Rydesky defendant Practice Group, as
outlined above to obtain adequate expert review and to file Certificates of Merit.
Accordingly, Plaintiff seeks leave of court to conduct pre-complaint discovery to draft
and file a sufficient Complaint and to obtain needed statements of merit.
B. The Information Sought From Pre-Complaint Discovery Is Material And
Necessary To The Filing Of The Complaint and Will Not Cause
Unreasonable Annoyance, Embarrassment, Oppression, Burden or Expense
to Any Party.
The Rules of Civil Procedure provides a two-prong test for pre-complaint discovery: (1)
the information sought must be material and necessary to the filing of the complaint, and (2) the
discovery will not cause unreasonable annoyance, embarrassment, oppression, burden or expense
to any person or party. Pa. R.C.P. 4003.8 with Explanatory Comment.
Here, Plaintiff satisfies the requirements of Rule 4003.8. First, a full and complete,
legible, certified copy of the entire dental chart is material and necessary to Plaintiff in drafting
and filing the Complaint. Plaintiff will be unfairly prejudiced without full and complete records
that are needed to obtain complete expert review and to draft and serve a sufficient Complaint.
Second, Plaintiffs request will not cause unreasonably burden, annoyance, embarrassment,
oppression or expense to any person or party. Thus, based on the foregoing, Plaintiff should be
granted leave to conduct pre-complaint discovery.
III. CONCLUSION
For the reasons set forth herein, Plaintiff respectfully requests this Honorable Court to
stay all proceedings in this Civil Action and to grant leave to Plaintiffs to conduct pre-complaint

A Rule to File Complaint was served on the Plaintiff on or about November 24, 2009.
Thereafter, a Consent Order was entered by the Court on December 8, 2009 which permitted
Plaintiff to conduct Pre-Complaint discovery. On July 12, 2010, the Court issued an Order
directing Plaintiff to file his Complaint on or before August 31, 2010. See July 12, 2010 Order at
Exhibit "A". Since no Complaint was filed by Plaintiff against Defendants, Stephen M.
Rydesky, Jr., D.M.D. and Stephen M. Rydesky, Jr., D.M.D., P.C., kindly enter Judgment Non-
Pros in favor of Defendants, Stephen M. Rydesky, Jr., D.M.D. and Stephen M. Rydesky, Jr.,
D.M.D., P.C., and against the Plaintiffs.
The undersigned counsel hereupon certifies that a written Notice of Intention to File the
Praecipe was mailed via certified mail to Plaintiff on September 1, 2009 after the failure to file a
Complaint against Defendants, Stephen M. Rydesky, Jr., D.M.D. and Stephen M. Rydesky, Jr.,
D.M.D., P.C., and at least ten (10) days prior to the date of the filing of the Praecipe. A copy of
the Notice, together with the Certified Mail Receipt, are attached hereto as Exhibit "B",
incorporated herein and made a part hereof.
In addition, pursuant to Pennsylvania Rule of Civil Procedure 237, the undersigned
counsel certifies that a copy of this Praecipe has been mailed to Plaintiff via certified mail return
receipt requested.
