THIS AGREEMENT made the 5th day of January, 2001, by and between RIDGEVIEW
CUSTOM HOMES, LLC, hereinafter referred to as Contractor, and DALE A. DETWEILER AND
JENNIFER A. DETWEILER, hereinafter referred to as Owner, whereby the former undertook and
agreed to erect and construct a custom built home on that certain lot of ground situate at 1.4 Acres
on Ridge Road, Southampton Township, Cumberland County, Pennsylvania, more fully described
in Exhibit "A' attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain tract of real estate lying and being situate in Southampton Township,
Cumberland County, Pennsylvania, more fully bounded and described as follows:
BEGINNING at a point in the Ridge Road; thence along the Ridge Road, North 34 degrees 18
minutes 40 seconds East, 149.00 feet to a point; thence along the same North 27 degrees 49
minutes 47 seconds East, 150.00 feet to a point; thence along lands now or formerly of Edna M.
Reese, South 63 degrees 29 minutes 44 seconds East, 200.00 feet to an existing iron pipe; thence
along the same South 31 degrees 53 minutes 00 seconds West, 332.30 feet to a set parker kalon
nail set in a rock; thence along lands now or formerly of Robert E. Fogelsanger, et al, North 53
degrees 41 minutes 47 seconds West, 195.41 feet to a point, the point and place of BEGINNING.
Containing 1.4279 acres as per survey prepared by Eric L. Diffenbaugh dated December 13,
2000, and intended to be recorded in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania.
BEING the same real estate that Paul E. Beals and Mary Louise Beals, his wife, by their deed
dated January 5, 20001, and intended to be recorded prior hereto in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, conveyed to Dale A. Detweiler and Jennifer
A. Detweiler, husband and wife, the Mortgagors herein..
