LAST WILL AND TESTAMENT
I, FRANCES A. WIDDERS, of the Township of Lower Allen,
County of Cumberland and Commonwealth of Pennsylvania, being of
sound and disposing mind, memory and understanding, do make,
publish and dedlare this as and for my Last Will and Testament,
hereby revoking and making void all former wills and codicils by
me at any time heretofore made.
FIRST. I order and direct that all my just debts and
funeral expenses be paid by my Executor, hereinafter named, as
soon as conveniently may be done after my decease.
SECOND. I give and bequeath my engagement and wedding rings
unto my niece, namely, LOIS ANN LINDSAY, absolutely, with the
wish and request that she not sell or otherwise dispose of them,
although she may reset the stone or stones therein into a
mounting more acceptable to her.
THIRD. I give, devise and bequeath all the rest, residue
and remainder of my Estate, real, personal and mixed, whatsoever
and wheresoever situated unto my husband, LLOYD B. WIDDERS,
absolutely and in fee simple, if he survives me by as many as
sixty (60) days.
FOURTH. If my husband, LLOYD B. WIDDERS, does not survive
me by as many as sixty (60) days, then and in such event, I order
and direct that the remainder of my Estate be distributed and
disposed of as follows:
A. I give and bequeath my kitchen table and four
matching chairs unto my niece, namely, LOIS ANN
LAW OFFIC£$

BRENNEMAN
& SPARE
Will and Testament, but if for any reason he should fail to
qualify as such Executor or cease so to serve, then and in that
event, I nominate, constitute and appoint my step-son, namely,
LAWRENCE I. WIDDERS, to be the Executor hereof, each and both to
serve without bond or other security as a condition of
qualification hereunder.
If both of the above named persons should fail to qualify as
my personal representative hereunder or cease so to serve, then
and in that ultimate event, I nominate, constitute and appoint
PNC BANK, NATIONAL ASSOCIATION, (or its successor by merger,
consolidation or other corporate reorganization) to be the
Executor hereof.
IN WITNESS WHEREOF, I, FRANCES A. WIDDERS, have hereunto set
my hand and seal to this, my Last Will and Testament which
consists of four (4) typewritten pages to each of which I have
affixed my signature this ~'~/ day of OdfO~ A.D., One
Thousand Nine Hundred Ninety-eight (1998).

I, FRANCES A. WIDDERS, of the Township of Lower Allen,
County of Cumberland and Commonwealth of Pennsylvania, being of
sound and disposing mind, memory and understanding, do make,
publish and declare this as and for my Last Will and Testament,
hereby revoking and making void all former wills and codicils by
me at any time heretofore made.
FIRS'l'. I order and direct that all my just debts and
funeral expenses be paid by my Executor, hereinafter named, as
soon as conveniently may be done after my decease.
SECOND. I give and bequeath my engagement and wedding rings
unto my niece, namely, LOIS ANN LINDSAY, absolutely, with the
wish and request that she not sell or otherwise dispose of them,
although she may reset the stone or stones therein into a
mounting more acceptable to her.
THIRD. I give, devise and bequeath all the rest, residue
and remainder of my Estate, real, personal and mixed, whatsoever
and wheresoever situated unto my husband, LLOYD B. WIDDERS,
absolutely and in fee simple, if he survives me by as many as
sixty (60) days.
FOURTH. If my husbahd, LLOYD B. WIDDERS, does not survive
me by as many as sixty (60) days, then and in such event, I order
and direct that the remainder of my Estate be distributed and
disposed of as follows:
A. I give and bequeath my kitchen table and four
matching chairs unto my niece, namely, LOIS ANN
LINDSAY, absolutely.
B. I give and bequeath my cedar chest unto my

c. I order and direct that all the rest, residue
and remainder of my Estate, real, personal and mixed,
shall be divided into three (3) equal parts to be
distributed and disposed of as follows:
1. I give, devise and bequeath one (1) such
part of my residuary estate unto my step-son,
namely, LAWRENCE I. WIDDERS, absolutely and in fee
simple, if he survives me.
2. I give, devise and bequeath one (1) such
part of my residuary estate unto my step-grandson,
namely, WILLIAM J. WIDDERS, absolutely and in fee
simple, if he survives me.
3. I give, devise and bequeath one (1) such
part of my residuary estate in equal shares unto
the then living children of William J. Widders,
share and share alike, subject to the protective
trust provisions contained in Item Fifth
hereinbelow.
If any of the foregoing beneficiaries should
predecease me, I order and direct that the foregoing
provisions to such deceased beneficiary shall lapse and
the subject matter thereof be added to the balance for
distribution and distributed among the remaining
beneficiaries as otherwise provided above.
FIFTH. If any beneficiary hereinabove has not attained the
age of thirty (30) years at the time of distribution, I order and
direct that the distributive share of such person shall be paid
over and delivered unto PNC BANK, NATIONAL ASSOCIATION, (or its
successor by merger, consolidation or other corporate
reorganization) as my testamentary Trustee, IN TRUST,

NEVERTHELESS, to hold, manage, invest, accumulate income and
reinvest until said beneficiary attains the age of thirty (30)
years, at which time said trust shall be terminated and the net
proceeds thereof be paid over to the beneficiary absolutely.
I authorize and empower my said Trustee to invest the
assets of said trust in any reasonable manner and not be limited
or restricted to so-called "legal" or statutory investments for
fiduciaries.
I designate any trust hereunder to be a spend-thrift
trust. The beneficiary shall have no right to invade, pledge,
assign or otherwise dispose of the assets of said trust
(including income) nor shall any creditor of a beneficiary have
any right to seize, levy or execute upon said assets by reason of
any pledge, assignment or other transfer, voluntarily or
involuntarily, made by said beneficiary.
I further authorize and empower my said Trustee to use,
consume, expend and apply from time to time such amounts of
principal and income of and from said trust which in the exercise
of its sole discretion shall be determined to be reasonable and
necessary for the beneficiary's education. The term "education"
shall be construed and interpreted to mean college or other post-
highschool training which is intended to improve the
beneficiary's productivity as an adult or enhance the quality of
his or her life. In considering what is reasonable and
necessary, my said Trustee shall take into consideration the
primary responsibility of the beneficiary's surviving parent to
provide such education. It is my will and intention that the
foregoing discretionary provision for education shall be
supplementary to the parent's primary responsibility.
LASTLY. I nominate, constitute and appoint my husband,
namely, LLOYD B. WIDDERS, to be the Executor of this, my Last

Will and 'I.'estament, but if for any reason he should fail to
qualify as such Executor or cease so to serve, then and in that
event, I nominate, constitute and appoint my step-son, namely,
LAWRENCE I. WIDDEHS, to be the Executor hereof, each and both to
serve without bond or other security as a condition of
qualification hereunder.
If both of the above named persons should fail to qualify as
my personal representative hereunder or cease so to serve, then
and in that ultimate event, I nominate, constitute and appoint
PNC BANK, NATIONAL ASSOCIATION, (or its successor by merger,
consolidation or other corporate reorganization) to be the
Executor hereof.
IN WITNESS WHEREOF, I, FRANCES A. WIDDERS, have hereunto set
my hand and seal to this, my Last Will and Testament which
consists of four (4) typewritten pages to each of which I have

and Testament of Frances A. Widders, Deceased, by his attorneys, Snelbaker & BJ{ynneman~~
P.C., and respectfully represents as follows:
1. Frances A. Widders, ("Decedent") died on May 27, 2004, as a resident of Lower
Allen Township, Cumberland County, Pennsylvania, leaving her Last Will and Testament dated
October 28, 1998, a true copy of which is attached hereto marked "Exhibit A", which Will was
duly probated and filed in the Office of the Register of Wills of Cumberland County,
Pennsylvania, on June 3, 2004, and Letters Testamentary were duly issued on the same date to
Lawrence 1. Widders, your Petitioner herein.
2. The Decedent's husband, Lloyd B. Widders, died on March 20,2004, thereby
obviating the residuary disposition under Item Third of Decedent's Will and activating the
provisions ofItem Fourth of said Will.
3. Included in said Item Fourth is the following relevant language:

C. I order and direct that all the rest, residue and remainder
of my Estate, real, personal and mixed, shall be divided into three (3) :
equal parts to be distributed and disposed of as follows:
1. I give, devise and bequeath one (1) such part of
my residuary estate unto my step-son, namely, LAWRENCE
1. WIDDERS, absolutely and in fee simple, ifhe survives me.

2. I give, devise and bequeath one (1) such part of
my residuary estate unto my step-grandson, namely,
WILLIAM 1. WIDDERS, absolutely and in fee simple,
if he survives me.
3. I give, devise and bequeath one (1) such part of
my residuary estate in equal shares unto the then living
children of William J. Widders, share and share alike,
subject to the protective trust provisions contained in Item
Fifth hereinbelow.
4. Lawrence I. Widders and William J. Widders survived the Decedent and are
entitled to the dispositive provision of Item Fourth, paragraph C, sub-paragraphs 1 and 2
5. Ian M. Widders, born on May 26, 1987, is the only child of William 1. Widders
and, therefore, is the sole beneficiary under Item Fourth, paragraph C, sub-paragraph 3 of said
Will.
6. Because the said Ian M. Widders is under the age of thirty (30) years, tl:ile
protective trust provisions of Item Fifth of said Will are invoked.
7. Item Fifth identifies PNC BANK, NATIONAL ASSOCIATION, ("PNC, N.A.")
as Testamentary Trustee.
8. Petitioner estimates that the distributive share of Decedent's Estate to Ian M.
Widders will be approximately $28,000, said share to be the opening corpus of the protective
trust.
9. PN C, N.A. has advised your Petitioner that the cost of its administratio(l of said
estate would not be economically beneficial to the beneficiary of the protective trust akd,

therefore, has declined and renounced its right to serve as such trustee and consents to land joins
in this Petition as evidenced by its Renunciation, Consent and Joinder attached hereto 'marked
"Exhibit B". PNC, N.A. has performed no services as such proposed trustee.

10. Because of the renunciation aforesaid, a vacancy has occurred in the position of
testamentary trustee.
11. Lawrence I. Widders (grandfather ofIan M. Widders) and William 1. Widders
(father ofIan M. Widders) have indicated their willingness to serve as co-trustees with the
survivor to serve as individual trustee in the event of the death, incapacity or resignati~n of either
of them, as documented by their consents contained in document attached hereto marked
"Exhibit C".
12. Ian M. Widders (now 18 years of age) consents to the proposed substitution of
trustees and the appointment of Lawrence I. Widders and William J. Widders as co-trustees as
contained in the Petition to which this document is attached marked "Exhibit D", and joins in the
prayer of said Petition
WHEREFORE, Petitioner respectfully requests the Court to recognize the vacqncy of the
position of testamentary trustee and, pursuant to 20 Pa. C.S. S 7101, to appoint Lawrel)ce I.
Widders and William J. Widders (or the survivor of them) as co-trustees without bond or other
security.

assets of said trust in any reasonable manner and notlbe limited
or restricted to so-called "legal" or statutory investments for
fiduciaries.
I designate any trust hereunder to be a spe~d-thrift
trust. The beneficiary shall have no right to invade, pledge,
assign or otherwise dispose of the assets of saidtru$t

(including income) nor shall any creditor of a benefi~iary have
any right to seize, levy or execute upon said assets ~y reason of

us, this day have, had and received of and from Lawrence I.
Widders, Executor of the Estate of Frances A. Widders, the cash,
personalty and/or real estate set opposite our names in the above
Statement of Proposed Distribution, in full satisfaction, payment
and discharge of all such sum or sums of money, legacies and
bequests, share or shares, purports and dividends which were due,
owing and payable and belonging to us, and each of us, by any
means whatsoever, for or on account of our full share, part or
dividend of the Estate of Frances A. Widders, Deceased.
NOW, THEREFORE, we, and each of us, the said Lawrence I.
Widders and William J. Widders, Co-Trustees for Ian M. Widders,
William J. Widders and Lawrence I. Widders, do by these presents,
remise, release, quit-claim and forever discharge the said
Lawrence I. Widders, his heirs, executors and administrators, of
and from our said shares or dividends of the Estate aforesaid,
and of and from all actions, suits, payments, accounts,
reckonings, claims and demands whatsoever, for or by reason
thereof, or of any act, matter, cause or thing whatsoever, from
the beginning of the world to the day and date of these presents.
AND, desiring to avoid the delay and expense of the
settlement of said Estate by filing the foregoing Account of said
administration in the Office of the Register of Wills of said

Cumberland County and by having the balance in the hands of the
Executor, as shown by said Account, distributed by the Court of
Common Pleas of Cumberland County - Orphans' Court Division, we,
and each of us, do hereby agree that the foregoing Account and
Statement concerning the matter of settlement may be recorded
with the same effect upon us, and each of us, as if the same had
been reported upon by said Court, in a decree of distribution
made on such proposed Statement of Distribution by the said Court
of Common Pleas - Orphans' Court Division.
AND in consideration of the aforesaid settlement being made
without the aid of such Court of Common Pleas - Orphans' Court
Division, that we, and each of us, the said Lawrence I. Widders
and William J. Widders, Co-Trustees for Ian M. Widders, William
J. Widders and Lawrence I. Widders, do hereby agree that if any
debts or demands other than those included in the above
referenced First and Final Account, as hereinbefore set forth,
shall be hereafter recovered against the Estate of said Decede~t
and be legally payable out of the same, that we, and each of us,
will return to the said Executor such amounts thereof as may be
necessary to pay such debts or demands.
