Lehman, of the Township of North Newton, Newville, Pennsylvania, carrying on a business at 105 Doubling Gap Road, in the said city of Newville, files his claim for the sum of Two Thousand Five Hundred Dollars and 00/100 ($2,500.00) together with interest and costs against Terry Bishop, and his agent, Terry Radabaugh, contractors and against all that certain dwelling at 799 Creek Road, Carlisle, for certain materials furnished and labor performed in doing the iron work in and about the said dwelling and makes the following statement of his demand: The name of the party claimant is Kenneth B. Lehman, and he files this claim as subcontractor. The name of the owner of said property at the time of the furnishing of said material and labor and the attaching of the lien therefore is the aforesaid Terry Bishop, and his agent, Danny Radabaugh, and his address is 799 Creek Road, Carlisle, Pennsylvania, 17013. The date of the completion of the claimant's work was September 22, 2000. The kind and character of the labor furnished by the claimant and the prices charged therefor is as follows: Fabricating iron railing, installing, priming and painting railing. The kind and character of the materials furnished by the claimant and the prices charged therefor is as follows: fabricated iron railing, installing, priming and painting same. Cost of material and labor total $2,500.00. 6. The amount claimed to be due is $2,500.00 The materials and labor furnished in and about the aforementioned dwelling were according to a certain contract between Terry Bishop, and his agent, Danny Radabaugh, the contractor, and said Kenneth B. Lehman, the subcontractor, entered into on or about September 10, 2001. The delivery of the said materials and the furnishing of said labor commenced on or about September 15, 2000, and the said Two Thousand Five Hundred Dollars and 00/100 ($2,500.00) is the balance due on the contract price as agreed upon by said contractor for the furnishing of the said materials and labor at the request of said owner and furnished to and supplied for and towards the aforementioned dwelling and on the credit of the said building continuously from September l 5, 2000 to September 22, 2000, inclusive, in accordance with and in fulfillment of the said contract. The lien is against the fee and is claimed from September 22, 2000. The said claimant has made repeated requests of said general contractor for the payment to him of the said balance of Two Thousand Five Hundred Dollars and 00/100 ($2,500.00) due him on said contract, which requests said contractor has ignored and refused to comply with. 10. The total sum to be paid to the said claimant by the said Terry Bishop, and his agent, Danny Radabaugh, under the terms of the said contract up to and including September 22, 2000, for the furnishing of the said labor and materials was Two Thousand Five Hundred Dollars and 00/100 ($2,500.00), The said claimant therefore claims to have a lien upon the said dwelling as hereinbefore described for the mount of the claim, the balance now due, the said sum of Two Thousand Five Hundred Dollars and 00/100 ($2,500.00), from the said 22nd day of September, 2000, according to the acts of assembly in such cases and made and provided.
