THIS AGREEMENT made this 9th day
between Norman Elam, a sole proprietor,
Contractor,
of February 2001, by and
hereinafter referred to as
Larry R. Walmer and Donna E. Walmer, husband and wife, hereinafter
referred to as Own/ers, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in West Pennsboro Township, CBa~berland County, Commonwealth
of Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #10, 26 Royal
Drive, Carlisle, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Exhibit A
ALL that certain tract of ground located in West Pennsboro Township,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin on the right of way line of Royal Drive between Lots
No. 9 and 10 of the hereinafter plan of lots; thence along said Royal Drive North 19
degrees 27 minutes 40 seconds East a distance of 200 feet to an iron pin; thence
along Lot No. 11 South 70 degrees 32 minutes 20 seconds East a distance of 469.79
feet; thence along the same South 4 degrees 48 minutes 29 seconds West a distance
of 206.72 feet to an iron pin; thence along the mentioned Lot No. 9 North 7 degrees
32 minutes 20 seconds west a distance of 522.08 feet to an iron pin, being the Place
of BEGINNING.
BEING Lot No. 10 of the Plan of Lots known as West Penn Estates as recorded in
Cumberland County Recorder of Deeds Office in Plan Book 79, Page 18.
BEING the same premises which Herbert J. Moffitt and Thelma L. Moffitt,
husband and wife, granted and conveyed to Larry R. Walmer and Donna E.
Walmer, husband and wife, Borrowers herein.
