Compromise and Settle Contingent Pecuniary Legacies, and after a hearing, it appearing that the proposed resolution is in the best interest of all parties (and otherwise satisfies 20 Pa. C.S. ~ 5306 and related provisions), it is hereby ORDERED AND DECREED that: 1. Heidi Fisher DeDay, the co-executor of the Estate of Glenn P. Hoffman, deceased (the "Estate"), shall pay $2,000 from the Estate to the Masonic Homes for Children in full and final settlement of its contingent interest under Item VII of the Decedent's Will. 2. The co-executor, Heidi Fisher DeDay, shall pay $2,000 from the Estate to the Masonic Homes for Children in full and final settlement of its contingent interest under Item VIII of the Decedent's Will. 3. The co-executor, Heidi Fisher DeDay, shall pay and irrevocably transfer $28,000 from the Estate into an account entitled James A. Hoffman as Custodian for Rochelle Marie Rose until age 25 under the Pennsylvania Uniform Transfers to Minors Act. 4. The co-executor, Heidi Fisher DeDay, shall pay and irrevocably transfer $28,000 from the Estate into an account entitled James A. Hoffman as Custodian for Dacoda John Rose until age 25 under the Pennsylvania Uniform Transfers to Minors Act (UTMA) . 5. With respect to the above-described UTMA accounts, the Custodian, James A. Hoffman (the "Custodian"), may pay to the beneficiary or expend for his/her benefit so much of the funds as the Custodian considers advisable from time to time; provided, however, that such funds shall be used solely to defray each beneficiary's undergraduate and/or post-graduate educational expenses and loans and shall be paid or expended only after the beneficiary attains a Bachelor's degree at an accredited college or university. In accordance with 20 Pa. C.S. ~ 5314, the Custodian may pay, reimburse, or expend such educational expenses and loans upon receipt of proper documentation and may do so without further court order and without regard to: (a) the duty or ability of any person to support the beneficiary; or (b) any other income or property of the beneficiary which may be applicable or available for that purpose. 6. Unless otherwise specified herein, all provisions of the Pennsylvania Uniform Transfers to Minors Act (20 Pa. C.S. ~ 5301 et seq.) shall apply to the above-described UTMA accounts and to the Custodian, including those governing the Custodian's duties and powers, his standard of care, his recordkeeping 2 responsibilities, and his entitlement to reimbursement for reasonable expenses and compensation. 7. The Custodian shall maintain each UTMA account until the funds have been exhausted or until the beneficiary attains the age of 25, at which time any remaining funds shall be distributed directly to the beneficiary, free of any further restrictions.
