Monn 802 Nottinghill Walk Apex, N C 27502 Mr. Monn: I am writing at the request of the Register to respond to a recent telephone conversation regarding anon-resident bond. Your Petition for Grant of Letters Testamentary in the Estate of William N. Monn was filed on November 12, 2009 and issued four days later on November 16, 2009. Please note that the issuance of Letters Testamentary within two business days is certainly not out of the ordinary. Pursuant to Pennsylvania Statute, and notwithstanding the Testator waiving bond in his Will, the Register of Wills has the discretion to require bond from an out-of-state Executor, under certain circumstances. Since your father had not waived the bonding requirement in his Will, but instead had provided Executor Powers to waive the bonding requirement, which powers technically could not exist until after the issuance of Letters Testamentary, the Register had the discretion to seek a bond.
