COMPLAINT IN DIVORCE
AND NOW, comes the Plaintiff, Charles D. Martier, Jr., by and through his attorneys,
Meyers, Desfor, Saltzgiver & Boyle and files the following Complaint in Divorce and in
support thereof avers as follows:

Plaintiff is Charles D. Martier, Jr., an adult individual who currently resides at 1705
Kent Road, Camp Hill, Pennsylvania.
Defendant is Linda S. Martier, an adult individual who currently resides at 1705 Kent
Road, Camp Hill, Pennsylvania.
Plaintiff has been a bona fide resident of the Commonwealth of Pennsylvania for at
least six (6) months immediately previous to the filing of this Complaint.
The Plaintiff and Defendant were married on June 26, 1982 in Orwigsburg,
Pennsylvania.
There have been no prior actions of divorce or annulment between the parties.
The marriage is irretrievably broken.
The Defendant is not a member of the United States Army or its allies.
Plaintiff has been advised that counseling is available and that Plaintiff may have the
right to request the court require the parties to participate in counseling, being so

advised, Plaintiff waives that right.
9. Plaintiff requests the Court to enter a Decree of Divorce pursuant to Section 3301(C)
or 3301(D) of the Divorce Code.
WHEREFORE, Plaintiff, Charles D. Martier, Jr., respectfully requests this Honorable
Court enter a Decree in Divorce pursuant to Section 3301(C) or 3301(D) of the Divorce Code.

10. Paragraphs one through nine of the Complaint are incorporated by reference as if fully
set forth herein.
11. During the marriage, Plaintiff and Defendant have acquired various items of marital
property, both real and personal, which are subject to equitable distribution under the
Divorce Code.
12. Plaintiff requests that this Honorable Court equitably distribute all marital property
pursuant to the Divorce Code.
WHEREFORE, Plaintiff, Charles D. Martier, Jr., respectfully requests this Honorable
Court equitably distribute all property, both real and personal, tangible and intangible,
acquired by the parties during their marriage.

AND NOW, come CONSTANCE P. BRUNT, ESQUIRE, and JOHNSON, DUFFLE,
STEWART & WEIDNER, P.C., and petition this Honorable Court as follows:
1. JOHNSON, DUFFIE, STEWART & WEIDNER, P.C., by CONSTANCE P.
BRUNT, ESQUIRE, are counsel of record for LINDA S. MARTIER, in the above-captioned
matters.
2. Said counsel have been required to terminate their representation of Ms. Martier
in this matter because of a breakdown in their attorney-client relationship.
3. Ms. Martier has been informed by CONSTANCE P. BRUNT, ESQUIRE, that she
can no longer represent her and of the intent to file this Petition for Leave to Withdraw as her
counsel.
4. The Honorable Edgar B. Bayley and the Honorable Edward E. Guido have
previously entered Orders of Court relating to Ms. Martier's Complaint for spousal support and
child support.
5. To counsel's knowledge, Ms. Martier has not yet retained substitute counsel.
6. Counsel has sought the concurrence in this Petition of LAURIE A. SALTZGIVER,
ESQUIRE, counsel for CHARLES D. MARTIER, JR., in the above matters, and counsel has
indicated that she does concur.
7. JOHNSON, DUFFIE, STEWART & WEIDNER, P.C., by CONSTANCE P.
BRUNT, ESQUIRE, respectfully request Leave of Court to withdraw as counsel for LINDA S.
MARTIER in the above matters.
WHEREFORE, Petitioners respectfully request this Honorable Court to enter a Rule
upon LINDA S. MARTIER and CHARLES D. MARTIER, JR., to show cause, if any they have,

DEFENDANT'S AFFIDAVIT UNDER SECTION 3301 (D)
OF THE DIVORCE CODE
The parties to this action separated in December, 2009, and have continued to live
separate and apart for a period of at least two (2) years.
2. The marriage is irretrievably broken.
I understand that I may lose rights concerning alimony, division of property, lawyer's
fees or expenses if I do not claim them before a divorce is granted.
I VERIFY THAT THE STATEMENTS MADE IN THIS AFFIDAVIT ARE TRUE
AND CORRECT. I UNDERSTAND THAT FALSE STATEMENTS HEREIN ARE MADE
SUBJECT TO THE PENALTIES OF 18 PA. C.S.A. SECTION 4904 RELATING TO

I understand that in addition to checking (b) above, I must also file all of my economic claims
with the prothonotary in writing and serve them on the other party. If I fail to do so before the date
set forth on the Notice of Intention to Request Divorce Decree, the divorce decree may be entered
without further notice to me, and I shall be unable thereafter to file any economic claims.
I verify that the statements made in this counter-affidavit are true and correct. I understand
that false statements herein are made subject to the penalties of 18 Pa.C.S. Section 4904 relating to
unsworn falsification to authorities.
