WHEREAS, Thomas W. Freysinger and Tamara K Freysinger of 5285 VAnthrop Avenue,
Mechanicsburg, PA 17050, is about to execute eontemporaneou* homwith, a conhud,
with C on Construction, Inc. of 1208 Summit Way, Mechanics", PA, for the erection of
a bldg upon promises camrnody known as 1404 Summit Way, Township Hampden,
Cumberland County, Pennsylvania, as set bflh in the deed dated 07/10/08, recorded at
Document Number 200824594 (pat of), in the Recorder's Office for Cumberland County,
Pennsylvania, as more specifically described in Exhibit W which is incorporated herein and
attached hereto.
NOW, November 20, 2009, at the time of and immediately before the execution of the
print it contract, and before any authority has been given by the said Owrw to the said
Con *cfjor to commence work on the said building, or purchase materlsk for the same in
consideration of the making of the said contract with Contractor and the further
consideration of One Dollar ($1.00), to c ont iclor paid by Omer, it is agreed that no lien
shell be fled against the bulking by the Contractor, or arty subcontrmtor, nor by any of the
mahwislmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erec ton of said building, the right to f such liens
being expressly waived.

ALL THAT CERTAIN of land situated in Hampden Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the western right-of-way line of Summit Way, said point
being the southeastern comer of Lot 23; thence North 62 degrees 23 minutes 43 seconds West, a
distance of 348.44 feet to a point on lands of others; thence along lands of others, South 74
degrees 31 minutes 45 seconds West, a distance of 57.64 feet to a point on the eastern line of
lands now or formerly of John C. & Lori A. Neal; thence along lands now or formerly of Neal
and lands now or formerly of Jeffrey L. Fisher, South 20 degrees 49 minutes 31 seconds East, a
distance of 165.63 feet to a point at the northwestern comer of Lot 21; thence along the northern
line of Lot 21, South 74 degrees 00 minutes 13 seconds East, a distance of 281.80 feet to a point
on the western right-of-way line of Summit Way; thence along Summit Way by a curve to the
right having a radius of 460.00 feet and an arc length of 93.20 feet to a point, the point and place
of BEGINNING.
BEING Lot 22 as shown on the plan entitled, "Final Subdivision Plan for Hampden
Summit Phase 4", prepared by R.J. Fisher and Associates, Inc., recorded in the Office of the
Recorder of Deeds for Cumberland County, Pennsylvania in Plan Book 94, Page 52.
UNDER AND SUBJECT to an existing Sanitary Sewer Easement as shown on above
referenced plan.
