HomeMy WebLinkAbout09-8387IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL DIVISION: LAW RAM-T CORPORATION No. 5; 3 1121 Downingtown Pike West Chester, PA 19380 Claimant vs. Adam & Kristen Goldfedder 4105 Willow Bend Road Mechanicsburg, PA 17055 Defendant Mechanics' Lien MECHANICS' LIEN CLAIM AND NOW, TO WIT, this the 4th day December, 2009, comes the Claimant, Ram-T Corporation by itself and files this claim against the improvements and property at 4105 Willow Bend Road, Lower Allen Towwnship, Cumberland County, Pennsylvania for the payment of a debt due Claimant as a subcontractor for labor and materials furnished by the Claimant in the erection and construction or alteration and repair of the improvements. In support of the claim, the Claimant makes the following statement: 1. Claimant is Ram-T Corporation, a domestic business corporation organized and existing under the laws of the Commonwealth of Pennsylvania, with its registered office address situate at 1121 Downingtown Pike, West Chester, Pennsylvania 19380. 2. Defendant(s) is/are Adam & Kristen Goldfedder his Wife, adult individuals, who currently reside at 4105 Willow Bend Road, Mechanicsburg, PA 17055. 3. Defendant(s) is/are the "Owner(s)" of the lot and improvements situate at 4105 Willow Bend Road, Lower Allen Township, Cumberland County, Pennsylvania, hereinafter the "Property", as those terms are defined in the Mechanics' Lien Law of 1963. 4. Claimant is a "Subcontractor" of Gemcraft Homes, Inc. as that term is defined by the Mechanics' Lien Law of 1963. 5. Claimant contracted with Gemcraft Homes Inc., with its registered office situate at 2205 Commerce Road, Forest Hill, MD 21050, which entity is the "Contractor", as that term is defined by the Mechanics Lien Law of 1963, to improve the property. 6. The labor and materials for which the debt is due were furnished for the agreed upon total sum of $795.00, pursuant to written invoice(s) with Gemcraft Homes, Incorporated, (a) true and correct copy (copies) of which are attached hereto. 7. The nature and character of the labor and materials furnished to improve the property consisted of all of the labor and materials necessary to overseed & straw mulch. 8. Claimant completed its work on or after June 30, 2009. 9. Claimant gave the Owner(s) formal written notice of its intention to file this Mechanics' Lien on November 4, 2009. 10. The property is or was addressed as 4105 Willow Bend Road and is more sufficiently described by the Cumberland County Recorder of Deeds as Parcel # 13-31- 2136-120. 11. Claimant has been paid $-0- of the money due, leaving a balance due and owing of $795.00, for which demand is hereby made. Wherefore, Claimant, Ram-T Corporation, respectfully requests your Honorable Court to enter a mechanics' lien in its favor and against the Defendant (s) of public record as prayed for herein in the full amount of $795.00, together with interest and costs as allowed by law, in all accordance with the Pennsylvania Mechanics' Lien Law of 1963.
