STIPULATION AGAINST LIENS
WHEREAS, Brian L. Fertenbaugh and Jennifer M. Fertenbaugh, husband and wife,
of Pennsylvania, is about to execute contemporaneously herewith, a contract with Classic
Communities Corporation, a Pennsylvania Corporation of Dauphin County, Pennsylvania, for the
erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN piece, parcel or lot of land, together with improvements,
situated in Hampden Township, Cumberland County, Pennsylvania and bounded and described as
follows:
BEGINNING at a point on the Western right-of-way line of Adam Lane (50.00 feet
wide), said point being located at the Southeastern corner of Lot No. 109; thence along said right-of-
way line South 11 degrees 37 minutes 33 seconds West, for a distance of 85.00 feet, to a point on
the arc of a circle curving to the right having a radius of 25.00 feet, and an arc length of 39.27 feet,
to a point along the Northern right-of-way line of South Deerfield Avenue (50.00 feet wide); thence
along said right-of-way line North 78 degrees 22 minutes 27 seconds West for a distance of 82.66
feet to a point at the Southeastern corner of Lot No. 96; thence along the Eastern boundary line of
said Lot No. 96, North 11 degrees 37 minutes 33 seconds East, for a distance of 110.00 feet to a
point along the Southern boundary line of Lot No. 109; thence along the Southern boundary line of
Lot No. 109 South 78 degrees 22 minutes 27 seconds East, for a distance of 107.66 feet, to a point
and the place of BEGINNING.
This piece, parcel or lot of land contains approximately 11,530.39 square feet of land, and is known
and numbered as Lot No. 95 on the Final Subdivision Plan for Good Hope Farms South - Phase XII,
which is recorded in Cumberland County in Instrument No.: 200914067.
BEING THE SAME premises which The McNaughton Company, a Pennsylvania Corporation, by
its deed dated the Zc4`day of November, 2009 and to be recorded simultaneously herewith,
granted and conveyed unto Brian L. Fertenbaugh and Jennifer M. Fertenbaugh, husband and wife,
NOW, the ') C'- day of November, 2009, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said Brian L.
Fertenbaugh and Jennifer M. Fertenbaugh, husband and wife to the said Classic Communities
Corporation, a Pennsylvania Corporation to commence work on the said building, or purchase
materials for the same in consideration of the making of the said contract with Classic Communities
Corporation, a Pennsylvania Corporation and the further consideration of One Dollar, to Classic
Communities Corporation, a Pennsylvania Corporation paid by Brian L. Fertenbaugh and Jennifer
M. Fertenbaugh, husband and wife it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
