1. The status of the above case is that hearings before the Auditor are scheduled to
begin Wednesday, December 16, 2009, and continue for Thursday, December 17, and Friday,
December 18, as necessary.
2. Martson Law Offices is counsel of record for George F. Dixon, III, and Richard E.
Dixon in the above two matters.
3. A conflict of interest has arisen between Martson Law Offices and its clients George
F. Dixon, III, and Richard E. Dixon which, pursuant to Rule 1.7 of the Pennsylvania Rules of
Professional Conduct, requires Martson Law Offices to withdraw as legal counsel for George F.
Dixon, III, and Richard E. Dixon.
4. Because of the conflict which has arisen as noted above, George F. Dixon, III, and
Richard E. Dixon need to retain other legal counsel and, correspondingly, require a general
continuance of the hearing scheduled to begin on December 16, 2009, pending their obtaining
replacement counsel.

5. George F. Dixon, III, and Richard E. Dixon concur with the request of Martson Law
Office to withdraw as legal counsel for them and desire a continuance of the hearings scheduled to
afford them the opportunity to retain replacement counsel.
6. The undersigned contacted counsel for the other parties in these two matters to seek
their concurrence and all counsel concur with this Petition with the understanding that all of the
documents contemplated in the Court's Order of November 25, 2009 have been disclosed.
WHEREFORE, Petitioner requests your Honorable Court to enter an Order in the form as
attached.
