The Plaintiff, Food Pro Corporation, is a corporation organized and existing under the laws of the State of Maryland, having its principal office and place of business at 321 East 5th Street, P.O. Box 698, Frederick, Maryland 21701. 2. The Defendant, THOMAS H. WOERNER individually and formerly trading as WOERNER'S FAMILY RESTAURANT, is an adult individual residing at 142 1S`n STREET, APT L, NEW CUMBERLAND, PENNSYLVANIA 17070-1179. CUMBERLAND COUNTY, F:AUSERV"PONYA\COMMON PLEASCMPS\COMPLA[NTS\FOODPR0.36182.wpd 2 3. On or about April 17, 2008, Defendant(s) submitted a Credit Application to Plaintiff, which credit was granted to Defendant(s), a true and correct copy of which is attached hereto, marked Exhibit "A" and made a part hereof. 4. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff's Statement of Account hereto attached, marked Exhibit "B" and made a part hereof, Plaintiff, at the special instance request of the Defendant(s), sold and delivered goods, wares and merchandise of the kind and description set forth on said Exhibit and/or performed labor and provided services of the kind and description set forth on said Exhibit to the total amount of SIXTEEN THOUSAND SEVEN HUNDRED FIFTY SIX DOLLARS AND FIFTY-SEVEN CENTS ($16,756.57). 5. The prices charged for said goods, wares and merchandise and/or services provided, were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant(s) promised and agreed to pay to Plaintiff. 6. Due to the default of Defendant(s), and pursuant to the terms and conditions of the Credit Application executed by Defendant(s) attached hereto as an Exhibit, attorney's fees in the total amount of FIVE THOUSAND TWENTY SIX DOLLARS AND NINETY-SEVEN CENTS ($5,026.97) have been added to said account.
