Section 5511, and following an initial period of hearing,
which has not yet been completed, the record shall remain
open, and a further half-day of hearing in this case is
scheduled for Wednesday, December 23, 2009, commencing at
9:30 a.m.
It is noted that at the time of adjournment
on today~s date Petitioner was presenting her case-in-chief,
and the Court had requested Petitioners counsel to present
testimony by Dr. John F. Mira with respect to his opinion
utilizing the language of the statute as to the alleged
incapacity of Lisa Marie DePietro.
It is noted further that at the time of
adjournment Petitioners Exhibit 1 (transcript of Dr. Mira~s
testimony at a deposition) had been identified and admitted.
No other exhibits had been identified or admitted.
