PennDOT proposes by Notice dated 11/12/09 to suspend Petitioner's operating/registration privileges for a period of 3 months, pursuant to Section 1786(d) of the Vehicle Code, effective 12/18/09 at 12:01 A.M. 3. The withdrawal and suspension of Petitioner's operating/registration privileges is unlawful for the following reasons: The violation is currently under appeal with the Dauphin County Court of Common Please - Case #256 SA 2009.
