GUTSHALL, husband and wife, Owner BLUE MOUNTAIN CONTRACTING, GROUP, INC. a Pennsylvania corporation, Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA WHEREAS, DARREN B. GUTSHALL and DOROTHY K. GUTSHALL, husband and wife, of 7 Garland Court, Carlisle, Pennsylvania 17013 (hereinafter together called "Owner"), are about to execute contemporaneously herewith, a contract with BLUE MOUNTAIN CONTRACTING GROUP, INC., a Pennsylvania corporation having a principal place of business at 641 Mallard Drive, Etters, Pennsylvania 17319 (hereinafter called "Contractor"), for the erection ora dwelling house upon a lot of land situate and described as follows: BEGINNING at a railroad spike set on Burnt House Road (T~542) at the northwest comer of Lot No. 10 on the said Plan; thence along said Lot No. 10 the following courses and distances: (1) South 15 degrees 35 minutes 00 seconds West 25.52 feet to an iron pin; (2) on a line curving to the right having a radius of 40.00 feet, an arc length of 48.51 feet, a chord bearing South 39 degrees 40 minutes 18 seconds East and a chord length of 45.59 feet to an iron pin; (3) on a line curving to the left having a radius of 225.00 feet, an arc length of 154.75 feet, a chord beating South 24 degrees 37 minutes 48 seconds East and a chord length of 151.72 feet to an iron pin; (4) South 44 degrees 20 minutes 00 seconds East 30.50 feet to an iron pin; (5) on a line curving to the right having a radius of 175.00 feet, an arc length of 172.06 feet, a chord bearing South 16 degrees 10 minutes 00 seconds East, and a chord length of 165.21 feet to an iron pin; (6) South 12 degrees 00 minutes 00 seconds West 89.87 feet to an iron pin; (7) on a line curving to the right having a radius of 175.00 feet, an arc length of 110.46 feet, a chord bearing South 30 degrees 5 minutes 00 seconds West, and a chord length of 108.64 feet to an iron pin; (8) South 48 degrees 10 minutes 00 seconds West 80.71 feet to an iron pin; (9) on a line curving to the left having a radius of 225.00 feet, and arc length of 198.31 feet, a chord bearing South 22 degrees 55 minutes 00 seconds West, and a chord length of 191.96 feet to an iron pin; (10) South 02 degrees 20 minutes 00 seconds East 90.96 feet to an iron pin; thence along Lot No. 4 on the said Plan, North 59 degrees 08 minutes 30 seconds West 586.23 feet to a concrete monument; thence along Lot No. 8 on the said Plan, North 18 degrees 35 minutes 05 seconds East 727.36 feet to a railroad spike set in the centerline of the said Burnt House Road (T-542); thence along and through the centerline of said Burnt House Road, South 71 degrees 24 minutes 55 seconds East 340,72 feet to a railroad spike, the Point and Place of BEGINNING. BEING Lot Number 9 on the said Plan and containing 9.707 acres. BEING ALSO commonly known and numbered as Lot #9 Burnt House Road, Carlisle, Pennsylvania 17013 and also identified as Cumberland County Tax Parcel Number 08-10-0630- 133. BEING THE SAME PREMISES which Ray L Wolfe, Jr. and Joan E. Wolfe, husband and wife, by their Deed dated November 20, 2002 and recorded November 21, 2002 in Cumberland County Deed Book 254, Page 3275, granted and conveyed unto Darren B. Gutshall and Dorothy K. Gutshall, husband and wife, Owners herein. NOW, ~ -- ~ ~ , 2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by Owner to Contractor to commence work on the said building, or to purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One and 00/100 ($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the above described premises and the building and improvements to be erected thereon, by Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person for any labor provided or materials purchased, or for extra labor provided or materials purchased for the erection of said building and improvements, the right to file such liens being expressly waived.
