On 02/25/2005 mortgagor(s) made, executed and delivered a mortgage upon the premises
hereinafter described to CHESAPEAKE MORTGAGE CONSULTANTS, INC. which mortgage
is recorded in the Office of the Recorder of CUMBERLAND County, in Mortgage Book No.
1898, Page 2545. By Assignment of Mortgage recorded 06/20/2005 the mortgage was assigned
to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. which Assignment is
recorded in Assignment of Mortgage Book No. 718, Page 2416. The PLAINTIFF is now the
legal owner of the mortgage and is in the process of formalizing an assignment of same. The
mortgage and assignment(s), if any, are matters of public record and are incorporated herein by
reference in accordance with Pa.R.C.P. 1019(8); which Rule relieves the Plaintiff from its
obligations to attach documents to pleadings if those documents are of public record.
4. The premises subject to said mortgage is described as attached.
The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 03/01/2009 and each month thereafter are due and unpaid, and by the terms of said
mortgage, upon failure of mortgagor to make such payments after a date specified by written
notice sent to Mortgagor, the entire principal balance and all interest due thereon are collectible
forthwith.

If the mortgage is reinstated prior to a Sheriffs Sale, the attorney's fee set forth above may
be less than the amount: demanded based on work actually performed. The attorney's fees
requested are in conformity with the mortgage and Pennsylvania law. Plaintiff reserves
its right to collect attorney's fees up to 5% of the remaining principal balance in the event
the property is sold to a third party purchaser at Sheriffs Sale, or if the complexity of the
action requires additional fees in excess of the amount demanded in the Action.
Plaintiff is not seeking a judgment of personal liability (or an in personam judgment)
against the Defendant(s) in the Action; however, Plaintiff reserves its right to bring a
separate Action to establish that right, if such right exists. If Defendant(s) has/have
received a discharge of personal liability in a bankruptcy proceeding, this Action of
Mortgage Foreclosure is in no way an attempt to reestablish such personal liability
discharged in bankruptcy, but only to foreclose the mortgage and sell the mortgaged
premises pursuant to Pennsylvania Law.

9. Notice of Intention to Foreclose as set forth in Act 6 of 1974, Notice of Homeowner's
Emergency Assistance Program pursuant to Act 91 of 1983, as amended in 1998, and/or
Notice of Default as required by the mortgage document, as applicable, have been sent to
the Defendant(s) on the date(s) set forth thereon, and the temporary stay as provided by
said notice has terminated because Defendant(s) has/have failed to meet with the Plaintiff
or an authorized consumer credit counseling agency, or has/have been denied assistance
by the Pennsylvania Housing Finance Agency.
WHEREFORE, PLAINTIFF demands an in rem Judgment against the Defendant(s) in the
sum of $159,420.87, together with interest from 12/15/2009 at the rate of $14.12 per
diem to the date of Judgment, and other costs and charges collectible under the mortgage
and for the foreclosure and sale of the mortgaged property.

LEGAL DESCRIPTION
ALL the following described two (2) tracts of real estate lying and being situate in the vicinity of Cleversburg,
Southampton Township, Cumberland County, Pennsylvania, bounded and described as follows:
TRACT NO. 1: BEGINNING at a spike in the center line of the road leading from Cleversburg to Mainsville, known
as Legislative Route 21006, which said spike is North 79 degrees 30 minutes East 250.00 feet from line of land now
or formerly of Clark W. Coy; thence with said center line of Legislative Route No. 21006, North 79 degrees 30
minutes East 100.00 feet to a spike at line of land now or formerly of J. Samuel Byers and Evelyn C. Byers; thence
with said land now or formerly of Byers, South 11 degrees East 150.00 feet to an iron pin; thence with the same,
South 79 degrees 30 minutes West 100.00 feet to an iron pin at line of land now or formerly of J. Samuel Byers and
Evelyn C. Byers, designated as Lot No. 3; thence with the same, North 11 degrees West 150.00 feet to the center line
of the aforesaid Legislative Route No. 21006, the first mentioned point and place of beginning.
CONTAINING in front on said Legislative Route No. 21006, 100 feet and extending at an even depth to a depth of
150 feet in the rear. The above description is in accordance with survey and plan by John Howard McClellan, C. E.,
dated August 8, 1966, and designated as Lot No. 4. Said lot comprises the easterly 100 feet of Parcel B as shown on
a survey and draft of William A. Brindle Associates dated October 22, 1973.
TRACT NO. 2: BEGINNING at a spike in the center line of the road leading from Cleversburg to Mainsville, known
as Legislative Route 21006, at line of land now or formerly of J. Samuel Byers and Evelyn C. Byers, his wife; thence
with said center line of Legislative Route No. 21006, North 79 degrees 30 minutes East 50 feet to line of land now or

East 150 feet to an iron pin at line of other land now or formerly of J. Samuel Byers and Evelyn C. Byers; thence
with the same, South 79 degrees 30 minutes West 50 feet to an iron pin at line of land now or formerly of J. Samuel
By6ers and Evelyn C. Byers; thence with the same, North 11 degrees West 150 feet to a spike in the center line of
said Legislative Route No. 21006, the first-mentioned point and place of beginning. BEING part of Parcel B as
shown on draft and survey of William A. Brindle Associates dated October 22, 1973. ALSO being the easterly 50
feet of a tract of land designated as Lot No. 3 as shown on a survey and plan by John Howard McClellan, C. S.,
dated August 8, 1966.
THE ABOVE DESCRIBED REAL ESTATE is the same which Bradley S. Coy and Renee S. Coy, his wife by deed
dated February 25, 2005 and intended to be recorded immediately prior to the recording of this instrument in the
Office of the Recorder of Deeds of Cumberland County, Pennsylvania conveyed unto Franklin M. Hershey, Jr. and
Nicole J. Hershey, his wife.
