COMPLAINT
AND NOW, this day of December , 2009, comes the Plaintiff, Greg Keller, by his
attorney, Diane G. Radcliff, Esquire, and files this Complaint against the Defendant, Donna
Francisco, whereof the following is a statement:
1. The Plaintiff is Greg Keller, an adult individual residing at 1200 Claremont Road, Carlisle,
Cumberland County, Pennsylvania 17015.
2. The Defendant is Donna Francisco, an adult individual residing at 139 North Orange
Street, Carlisle, Cumberland County, Pennsylvania 17013.
3. On or about February 7, 2002, the parties entered into an oral contract wherein Plaintiff
agreed to lend Defendant the amount of $10,000 and Defendant agreed to borrow from
Plaintiff the said $10,000, under and subject to the conditions that said sum was to be
repaid together with interest thereon at the rate of 6% per annum in 48 equal monthly
installments of $234.85 with the first payment to be paid on March 15, 2002 and the last
payment on March 15, 2006.
4. Pursuant to the parties' agreement, on December 7, 2002, Plaintiff lent Defendant the
sum of $10,000.00.
5. To evidence the aforesaid loan, Defendant executed a note in favor of Plaintiff dated
February 7, 2002, a true and correct copy of which is attached hereto, marked Exhibit
"A" and made a part hereof.
6. Subsequent to February 7, 2002, Defendant made various payments on the loan totaling
$8,082.58, $2,964.02 of which was applied to interest and $5,118.56 of which was
applied to principal, leaving a balance due and owning to Plaintiff of $4,881.44 as of
December 14, 2009 as set forth on the amortization schedule attached hereto, marked
Exhibit "B" and made a part hereof.
7. Defendant is in default of the terms of the parties' agreement and the note attached as
Exhibit "A" in that Defendant failed to make all of the $234.85 monthly payments
required by the agreement and the note in a timely manner leaving a current balancing
owing by Defendant to Plaintiff of $4,881.44, as set forth in the amortization schedule
attached as Exhibit "B".
WHEREFORE the Plaintiff requests this Honorable Court to enter judgment in favor of the
Plaintiff and against the Defendant in the amount of $4,881.44 together with cost of suit and
interest at the rate of 6% per annum from and after December 15, 2009 until the same is paid
in full.

11 272-81 (eleven thousand, two hundred, seventy-two

thirty-four dollars and eighty-five cents). First payment
