RICHARDSON I, BETTY J. RICHARDSON, a single woman and widow, of Lemoyne Borough, Cumberland County, Pennsylvania, do make, publish and declare this to be my Last Will and Testament, hereby revoking all Wills and Codicils by me at any time made. RICHARDSON, providing she shall survive me by thirty (30) days. In the event my daughter LORIE A. RICHARDSON predeceases me or dies within thirty (30) days of my death, then I give, devise and bequeath my estate, whatsoever the same may be and wheresoever the same may be situate, to my six (6) grandchildren who shall receive equal shares of my estate, subject to the terms and conditions of the Young Person's Trust specified below in Item III. ITEM III: Young Person's Trust -The term "beneficiary" in the following trust provisions shall mean the young person (as "young person" is specified in Subsection A of this Young Person's Trust) for whom the Young Person's Trust is being administered. My Trustee shall hold, administer, and distribute all property passing under this Will to a Betty J. Appointment of Trustee I name my sister, Shirley Nett as Trustee, to serve wit~h~o`ut bond or other surety. If this person is unwilling or unable to serve, I name NtTT to serve as alternate Trustee, also to serve without bond or other surety. C. Trust Provisions (1) Until the termination date, my Trustee shall distribute to or for the benefit of each beneficiary as much of the net income and principal as my Trustee deems necessary for the beneficiary's health, education, maintenance, and support, annually adding to principal undistributed income. (2) Upon termination of this Young Person's Trust, the remaining trust principal and accumulated income shall pass to the beneficiaries, if alive. In the event any of the beneficiaries are not alive, I direct the remaining trust principal and accumulated income Betty J. D. Trustee Powers In addition to the other powers granted to the Trustee in this Will, the Trustee shall have all powers generally conferred on Trustees under the laws of Commonwealth of Pennsylvania. The Trustee shall also have all powers conferred on my Executor in Section V. of this Will. Additionally, the Trustee shall have all powers to hire and pay from the assets of the Young Person's Trust reasonable fees necessary to administer the Young Person's Trust and manage any asset of the Young Person's Trust. E. Trust Provisions (1) The situs of each of the Young Person's Trusts created hereunder may be selected by the Trustee in her sole discretion, and may be changed from time to time by the Trustee. (2) The interests of the Young Person's Trust beneficiaries shall not be transferable by voluntary or involuntary assignment or by operation of law and shall be free from the claims of creditors and from attachment, execution, bankruptcy, or other legal process to the fullest extent permissible by law. (3) Any Trustee serving shall be entitled to reasonable compensation for her services. Any corporate Trustee (if appointed) shall be entitled to receive compensation for its services in an amount to be determined from time to time by the application of the current prevailing rates then charged by such corporate Trustee for estates or trusts of a similar Betty J. (4) The alternate Trustee then serving may appoint in writing an individual or a corporation possessed of trust powers to succeed him or her as Trustee, and such appointment shall become effective when accepted by such successor Trustee. (S) Upon sixty (60) days prior notice to the Trust beneficiaries, any Trustee serving hereunder may resign without the approval of a court or any Trust beneficiary provided that after such resignation there shall remain at least one Trustee. (6) If no Trustee is serving, then a replacement Trustee to fill such vacancy shall be appointed by the adult beneficiary of the Trust, or by the Guardian of such beneficiary if a minor. (7) Any successor Trustee, however appointed, shall be relieved of any and all liability for any acts or omissions of the predecessor Trustees in respect to the administration of this Trust and may, without liability, accept without examination or review the accounts rendered and the property delivered by any predecessor Trustee. ITEM IV: I appoint LORIE A. RICHARDSON, my daughter, Executrix of this my last Will. In the event LORIE A. RICHARDSON fails to qualify or ceases to act as Executrix, I appoint my sister, SHIRLEY NETT as Executrix of this, my Last Will. My Executrix shall not be required to give any bond or bonds. ITEM V: In addition to the other powers and authorities grated to my personal representative by Pennsylvania law and by the other terms and provisions of this Will, I hereby give to my personal representative the following powers and authorities effective Betty J. Richardson: 'S Witness #1 initials: Witness #2 initials: Witness #3 initials: Page4of7 without court approval and until actual distribution of all property; to compromise any claim or controversy; to make distribution in cash or in kind, or partly in cash and partly in kind, and in such manner as my personal representative may determine and at valuations finally to be fixed by them; to invest in all forms of property, including any stock or other securities in an corporate fiduciary or its successor without restriction to investments authorized for Pennsylvania fiduciaries, as my personal representative deems proper, without regard to any principle of risk or diversification; to sell at public or private sale, to exchange, or to lease for any period of time, any real or personal property and to give options for sales, exchanges, or leases, for such prices and upon such terms or conditions as my personal representative deems proper; and to allocated receipts and expenses to principal or income or partly to each as my personal representatives deem proper in their sole discretion.
