HomeMy WebLinkAbout01-04-10 (11)Will No. 21-07-01162 RECEIPT AND RELEASE KNOW ALL MEN BY THESE PRESENTS, that Castaway Critters~successor to Stray Cat Alliance ("Recipient"), by its undersigned authorized officer, hereby acknowledges that upon execution of this agreement it will receive from David M. Rothert, Executor of the Last Will and Testament of JAMES W. FRY, deceased, cash in the sum of One Hundred Thi -Three Thousand Nine Hundred Fiftv and 00/100 Dollars ( 133 950 001, which when added to the sum of Seventy-five Thousand and 00/11 Dollars $75 000.00 said Executor, totals Two Hundred Eieht 'Thousand Nine Hundred Fiftvc nrj Ob100 Dollars from 1$208.950.001, being the sum distnbutable to ~t under sand Last Will and Testament. RECIPIENT AGREES to refund to the Executor any portion of the distribution to which it is not entitled, and to the extent of said distribution, to indemnify him for claims made against him as Executor for all expenses and costs incurred in connection with any such claims, and agrees to refund to the Executor any sums of money which represent Recipient's proportional share of any additional taxes or other appropriate expenses which are, or may become, charges against the Estate. RECIPIENT HEREBY WAIVES the right to require the filing of an account by the Executor in the Court of Common Pleas of Cumberland County, Pennsylvania, Orphans' Court Division or elsewhere, or any adjudication in any Court, and agrees to this amicable settlement and distribution of the above stated balance, which includes any and all interest accruing to the date of distribution. NOW, THEREFORE, in consideration of the distribution of the above stated amount, Recipient does hereby, by these presents, remise, release, quitclaim and forever discharge David M. Rothert, Executor, his successors and assigns from any further claim in connection with this Estate.
