Along with this invoice are most documents that show the contacts, research, and time involved to acquire such invoice. Attorney Beckley has been more than patient and, through correspondence to you, has completed all inquiries you may have had. Please have this invoice of 1 790.00 paid at once. At this time, I am also forwarding my own claim for personal services rendered that my cousin Carole had expected to pay when I was remodeling her kitchen. Should you require all receipts, I will be happy to supply them. The total due me for her kitchen renovation is 370.22. Not added to this expense are my paint supplies used that were cleared from the house at some point; I was not entitled to know when Carole's home was cleared nor the destination of her belongings. Other items totaling $206.71 (which includes a funeral luncheon that the Wallace's attended after Carole's burial) as well as the many hours in which I engaged myself to the benefit of the Wallace family, I consider my "offering". I had received frequent phone calls at work from your secretary and offered her direction and all the information I could. Some of her questions had to do with household bills, particularly the heating bill, which seemed to be thoroughly examined prior to payment. Of course, I was the only person to ask as I was the only person who took responsibility for Carole's health and well-being. I think you have done the same with your interaction with Attorney Beckley in regards to the Estate as you did when finally paying Parthmore's Funeral Home after a lengthy time lapse. As Carole's "adopted daughter" (if you know Carole you know her words) I would naturally be the one to continue to take care of her intentions; but nature is not necessarily the law. Because Carole's Will was not updated, it is considered by law to be "lapsed". It is now essential that Carole's Estate be appointed an Administrator by her successors. I have all of Carole's legal documents and have, to date, been able to take care of her affairs but, legally, her bills cannot be paid (i.e. heat, burial, taxes, etc.) until I or someone is appointed by you. As Carole's 1St cousin and legally next in succession being no living aunts or uncles, you must give your permission for me to act as Administrator. The last time we spoke, Patti was in the hospital so please give her my best wishes. I wanted to send you copies of the forms sent to the Register of Wills in Carlisle. Please know that I got them there immediately upon request and I hope they are acceptable to them. My brothers all signed them the day of Carole's funeral which, for all we knew at that time, I was the likely one to take care of the Estate. As you can see, I "whited-out" my name and put "1St cousins". This was faster than going around to all the boys and getting signatures, especially with my brothers Frank and Tom being out of town most of the week. Anyhow, good luck to you and your family. I stress about the length of time this is taking you with your attorney. I'm sorry your family didn't contact the attorney I had gone to as he came well recommended and was not out to take your inheritance. I sincerely hope your attorney is not taking more than he should or deserves. He should have a % and/or a set dollar amount to receive for his services; whichever is lower. Also, with the market the way it is, the longer things take, the more loss in any investments. I'm sure you know this, so forgive my worries. The house is OK. The oil was filled right before Carole died and I believe it was filled again. Checking the last week in February there was still %2 tank full. Mike Bircher (my Mike) had turned the heat down quite a bit for obvious reasons. I am picking up the mail about every 1-2 weeks and keeping it together for you. I have not opened anything except the funeral bill. The man who did the work on the kitchen is also expecting payment but he knows the situation.. (His mother Betty lives next door). I am going to call the funeral director today (I've been "chicken" to give him a call). Anyhow, I hope your plate is not too full, but I'm sure it is as I know how it is with multiple siblings and distance and personalities. I think attorneys want to "control" all in these situations and I was asked not to call you.....so I'm writing just to touch base. McCaleb, Esq. 219 East Main Street Mechanicsburg, PA 17055 RE: Estate of Carole Jean Rudy-Patterson Dear Attorney McCaleb: It is with great relief that, after nearly six months since informing Carole's 1St cousins that they are the beneficiaries of her Estate (letter attached), your office has called to claim important documents in my possession. What could have been a swift and easy process has unfortunately been complicated by human distrust, ignorance, and greed. Carole would be appalled; as I am appalled that her humble home and prudent life-savings are too meager for the "opportunists" who didn't even know her or, for that matter, be involved in her life. My brothers, father, and I have been fortunate to have known and loved this woman all of our lives and have the family traditions and memories with Carole. We need nothing more than to make sure that decency is addressed to her name and her wishes, hence, my reason for writing. My mother, Patricia Sullivan Kempf was Carole's sole beneficiary of her lapsed will. Regardless, Carole chose her because of their life together and how my mom and dad always took care of her needs. When my mother died three years ago, I continued that care. I was the known family member to be contacted when Carole first went into cardiac arrest, as well as the one asked by the hospital to release her body. I was the one her doctor's office contacted to find out the chain of events leading up to her attack, and I was the family who knew what funeral services cared for her mother and dad when they died, and what Carole's wishes were for herself....."just like mother and daddy". She always introduced me as her "adopted daughter"; I was her confidant, cousin, and friend. This brief introduction of my relationship to Carole is, hopefully, to offer a view of the woman whose belongings have become a gift to those beneficiaries. 2 In opposition to having a lapsed Will, Carole's frugal lifestyle was responsibility planned and documented. Each piece of mail that came into the house (which fills her living room and dining room) was put back in its envelope, dated, and filed in one of the many boxes that cover her living room couch, floor, and dining room table. Drawers are stuffed with cards, letters, more mail, old paystubs, old everything. Other than the four or five years she was married as a young woman, Carole lived with her mother and dad in their home. Mary died in 1984 and Cally in 1994 and, to this day, their belongings remain in the exact same places; pajamas in drawers, cover-alls on the hook going down the basement steps. Carole was eccentric to say the least. She would go to the grocery store at 11:00 p.m. and park her car on the front lawn to unload bags into the house. She saved every paper tube that finished a roll of paper towels and stored bags of bags of bags. She never cleaned and would store dirty pans in her oven, which was never used. Although there is a bed in her living room, she slept in her recliner for the past 18 years watching her favorite TV shows all day or night, hoping for a Yankee game. Her car was her prize possession but truly wanted to, just one more time, buy another Mustang. Carole always did her bookwork, paying invoices on time and knowing how many bills were in her $5 envelope, $10 envelope, and $20 envelope that her friends at PNC would assemble for her on bank day. Her clothes were always stained, but clean, she only had a few teeth but never left the house without lipstick on, and infused a car with drug store perfume. Her humor was constant, her memory was sharp, and she had a temper. I always hoped that I would never have to place her in a retirement home or that she would need lengthy medical attention because that would have been very difficult. She simply would have refused. Hoping you are getting a picture of Carole, it is up to you as to whether or not you will follow her wishes. I believe that the law upholds decency. She, like most people, had planned for her Estate to: 1. Pay all outstanding bills; utilities, construction, legal, funeral, etc. 2• Give her car to Ralph Paulus (who always took care of her car). The whole town knew Ralph was to have the car. My opinion is that everything her 1St cousins are receiving from her life is a gift; one which was definitely not approved by Carole. This was a gift she chose to give; Ralph should have her car. 3. Secure her home. I secured her home the best way I could when she died. I gave her car to Ralph because there was no way to secure the safety of the car sitting in her driveway or in an unlocked garage. I removed a small pistol from the house, checked the oil all winter, collected the newspapers and mail, and turned lights on and off. The Wallace's knew I was doing this as I kept them informed. 3 Other than the two items mentioned above, all that was removed from Carole's home by family members were two cedar chests. O (Q s. 2[lQpU^ ,~ June 18, 2009 J~f'~ ~~~ ,/.~, ~ , ~ ,~~,~ Dear Julie and Ralph(ie), O ~~, ~~~~~ You probably are by now aware that the Court has not given authorization to execute Carole's Estate to the Wallace's because Mr. Wallace (the leader of the pack) has not even seen Carole in 30 years. Instead, the Court appointed Attorney McCaleb in Mechanicsburg to oversee and execute her Estate. If I see you some day I'll tell you that humorous story. My next door neighbor, Jack, informed me that you are very interested in buying Carole's home. I want you to know that I informed the Attorney's Assistant, Emily, of this. She seemed happy to hear that. When she asked me for your number to obtain the car keys, I wasn't surprised, but I certainly reacted surprised and stated, "No! You're not going to ask him to give the car back, are you?" Anyhow, I have enclosed a letter that I wrote to Mr. McCaleb when I dropped off all of Carole's documents and mail. I was both relieved and sad that it has come to this. My family just doesn't do things this way, nor did Carole. I'm sending you a copy of this letter to show you of my support in honoring what I knew Carole wished. I'm sorry that I did not return telephone calls but, to be honest, I didn't know anymore who was saying what and to whom. Talk around her neighborhood was that I wanted the house. Mr. Wallace stated that I had done underhanded and illegal things and that he "will deal with me later" as the two sisters who ate with us after Carole's funeral, sat in silence. All these lies have caused me stress. Those who did for Carole all seem to feel they deserve something. Whatever happened to kindness; giving without receiving. Anyhow, my brothers and I are simply done with these types of people. "Let the people talk!" my grandmother would say. I hope things work out your way. As I am finally able to hand things over to someone who will see that things are done properly, my heart fills with the loss of Carole in my life; a feeling that the busyness and responsibilities have restricted. What a learning experience and an eye-opener into a family very much unlike yours and mine. Now I know why we never knew "that side" of my mother's family! Carole was mom's last living relative and my parents cared for her for many years. Once mom died, I took over her care. She was eccentric to say the least, and I knew her Will had not been updated since mom died. She had named mom as sole beneficiary and dad as the executor and, of course, we thought she had a few more years with us. The beneficiaries turned out to be second cousins that had not seen Carole in 30 years. Needless to say, Carole's financial matters were on hold much longer than I would have allowed. My brothers and I did nothing to contest her Will but the beneficiaries were scattered all over the U.S. and many not even speaking to one another. The Courts finally granted the role of Executor of the Estate to the attorney in Mechanicsburg. I am so pleased that `you received payment in full and that my embarrassment is over. Thank you again for being there for me and trusting me as a "Kempf". I knew the Estate had plenty of funds to pay any outstanding bills but if I would have paid you first, things could have been more complex. Who knows!
