THIS AGREE~"TT made the 7TL of ~~ , 2001,
and between J.W. MUMPER CONSTRUCTION, INC., Contractor,
by
CRAIG D. BROSIOUS and DONNA J. BROSIOUS, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
UDperAllen Township, Cumberland County, Pennsylvania, more
particularly described in attached Exhibit "A", also referred
to as 47 ~%nlyn Lane, Mechanicsburg, Pennsylvania.
NOW THEREFORE, T~iS AGREF~T WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to J.W. MUMPER CONSTRUCTION, INC. in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties actin9
through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of
them against the said buildings and the lot of 9round appurtenant
thereto for or on account of any work done or materials furnished
by them Or any of them under said contract or otherwise, for,
towards, in, or ~bouz the erection and construction of the said
buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said
buildings or any of ~hem, and agree that this instrument, waivin~
the right of lien, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN piece, parcel and lot of land situate in the
Township of Upper Allen, County of Cumberland, Commonwealth of
Pennsylvania; being more fully described as follows, to wit:
BEGINNING at a point on the dividing line of Phase I and Phase
II of the Final Subdivision Plan of Lindenwood, Phase II prepared
by Dawood Engineering, Inc., dated December 1, 1998 and latest
revision dated March 25, 1999, said point also being located on
the eastern right-of-way line of ~mlyn Lane, said point also
being located at the southernmost corner of Lot No. 40 of the
Final Subdivision Plan of Lindenwood, Phase I, prepared by Dawood
Engineering, Inc. dated February 3, 1997 and latest revision
dated September 29, 1997; Thence along said Lot No. 40 South
Seventy Four Degrees Forty Four Minutes Zero Seconds Eas% (S 74
degrees 44' 00" E) a distance of Two Hundred and Seventy Six
Hundredths feet (200.76 feet) to a point on the western
right-of-way of South Market Street (SR 114 L.R. 416) at the
southeasternmost corner of the aforesaid Lot NO. 40; Thence along
the western right-of-way of South Market Street (SR 114 L.R. 416)
South Fifteen Degree~ Sixteen Minutes Zero Seconds West (S 15
degrees 16' 00" w) a distance of One Hundred Eighty Five and One
Hundredths Feet.(185.01 feet) to a point at the northeasternmost
corner of Lot No. 37 of the aforesaid Lindenwood, Phase II Final
Subdivision Plan; Thence along said Lot No. 37 and continuing
along Lot No. 38 of the aforesaid Lindenwood, Phase II Final
Subdivision Plan North Fifty Two Degrees Thirty Eight Minutes
Twenty two Seconds West (N 52 degrees 38' 22" W) and a distance

fee=) to a point on the eastern right-of-way of ~mlyn Lane;
Thence along the eastern right-of-way of B%nlyn Lane by a curve to

feet (300.00 feet) an arc length of Ninety Seven and Forty Six
feet (97.46 feet) with a chord bearing of North Twenty Eight

Hundredths feet (97.03 feet) =o a point on the above referenced
dividing line of Phase I and Phase II at the southernmost corner

Co-Trustees of the Philip B. ~la±ze Trust B, by Quit Claim Deed
dated October.22, 1997 and recorded October 27, 1997 in the
Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Deed Book 166, Page 732, granted and conveyed
unto Lindenwood, Inc., a Pennsylvania corporation.
