COMPLAINT IN ACTION TO QUIET TITLE
AND NOW, comes Plaintiffs, Randal L. Brown & Janey Gunn, by and through their
counsel, Serratelli, Schiffinan, Brown & Calhoon, P.C., and file their Complaint against
Defendant, Denise M. Sobolewski, and in support thereof avers as follows:
The Parties
1. Plaintiff Randal L. Brown (hereinafter "Plaintiff Brown") is an adult individual
who currently resides at 3800 Lisburn Road, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
2. Plaintiff Janey Gunn (hereinafter "Plaintiff Gunn") is an adult individual who
currently resides at 3800 Lisburn Road, Mechanicsburg, Cumberland County,
Pennsylvania 17055.

3. Defendant Denise M. Sobolewski (hereinafter "Defendant Sobolewski") is an
adult individual who currently resides at 1041 Rhoda Boulevard, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
Background
4. The averments set forth in paragraphs 1 through 3 are incorporated by reference
as if more fully set forth at length herein.
5. Plaintiff Brown is the record title holder of real property located in Monroe
Township, Cumberland County, Pennsylvania, which is identified as Tax Parcel Number
22-12-0350-063 (hereinafter "Brown Parcel"). A true and correct of the deed to the
Brown Parcel, recorded in the office of the recorder of deeds for Cumberland County at
Book 196, Page 34, is attached hereto as Exhibit "A."
6. Plaintiff Gunn is the record title holder of real property located in Monroe
Township, Cumberland County, Pennsylvania, which is identified as Tax Parcel Number
22-12-0350-062 (hereinafter "Gunn Parcel"). A true and correct copy of the deed to the
Gunn Parcel, recorded in the office of the recorder of deeds for Cumberland County at
Book 194, Page 574, is attached hereto as Exhibit "B."
7. Defendant Sobolewski is the record title holder of real property known as 1052
Rhoda Boulevard, Mechanicsburg, Cumberland County, Pennsylvania 17055, identified
as Tax Parcel Number 22-12-0348-034 (hereinafter the "First Sobolewski Parcel"). A
true and correct copy of the deed to the First Sobolewski Parcel, recorded in the office of
the recorder of deeds for Cumberland County as Instrument Number 200824263, is
attached hereto as Exhibit "C."

8. Defendant Sobolewski is also the record title holder of real property known as
1041 Rhoda Boulevard, Mechanicsburg, Cumberland County, Pennsylvania 17055,
identified as Tax Parcel Number 22-12-0350-061 (hereinafter the "Second Sobolewski
Parcel"). A true and correct copy of the deed to the Second Sobolewski Parcel, recorded
in the office of the recorder of deeds for Cumberland County as Instrument Number
200824264, is attached hereto as Exhibit "D."
9. In March, 2009, Group Hanover Engineers and Surveyors, Inc. prepared a survey
of the the First Sobolewski Parcel, the Second Sobolewski Parcel, the Brown Parcel, and
the Gunn Parcel (hereinafter "the Survey"). A copy of a map showing the location and
relationship between all Parcels which was prepared pursuant to the Survey is attached
hereto as Exhibit "E."
10. The Brown Parcel, Gunn Parcel, First Sobolewski Parcel, and Second Sobolewski
Parcel are adjacent and contiguous. See Exhibit "E."
11. The Survey shows that the Brown Parcel and the Gunn Parcel do not have any
public road frontage and thus are completely landlocked. See Exhibit "E."
12. A private unpaved road which passes through the First Sobolewski Parcel and the
Second Sobolewski Parcel allows Plaintiff Brown and Plaintiff Gunn to access the Brown
Parcel and the Gunn Parcel (hereinafter "the Road"). See Exhibit "E."
13. The Road also passes through a parcel of real property owned by Rodney D.
Morgan (hereinafter "Morgan"), known as 1133 Rhoda Boulevard, Mechanicsburg,
Cumberland County, Pennsylvania 17055, which is identified as Tax Parcel Number 22-
12-0348-033 (hereinafter "Morgan Parcel"). See Exhibit "E."

14. Plaintiff Brown has obtained an easement over the portion of the Road which
passes through the Morgan Parcel, as evidenced by an Easement Agreement which was
executed on or about October 26, 2009 and recorded in the Cumberland County Office of
the Recorder of Deeds as Instrument Number 200939418.
15. Plaintiff Gunn has obtained an easement over the portion of the Road which
passes through the Morgan Parcel, as evidenced by an Easement Agreement which was
executed on or about October 26, 2009 and recorded in the Cumberland County Office of
the Recorder of Deeds as Instrument Number 200939417.
16. The Road also passes through a parcel of real property owned by Christopher and
Sharon Zettlemoyer (hereinafter collectively "the Zettlemoyers"), known as 1117 York
Road, Mechanicsburg, Cumberland County, Pennsylvania 17055, identified as Tax Parcel
Number 22-12-0348-032 (hereinafter the "Zettlemoyer Parcel"). See Exhibit "E."
17. Plaintiff Brown has obtained an easement over the portion of the Road which
passes through the Zettlemoyer Parcel, as evidenced by an Easement Agreement which
was executed on or about November 9, 2009 and recorded in the Cumberland County
Office of the Recorder of Deeds as Instrument Number 200939416.
18. Plaintiff Gunn has obtained an easement over the portion of the Road which
passes through the Zettlemoyer Parcel, as evidenced by an Easement Agreement which
was executed on or about November 5, 2009 and recorded in the Cumberland County
Office of the Recorder of Deeds as Instrument Number 200939415.
19. In November, 2008, Defendant Sobolewski placed a locked chain across the
portion of the Road which passes through the Second Sobolewski Parcel in an effort to
prevent and/or limit access to the Brown Parcel and the Gunn Parcel.

20. As of the date of the filing of this Complaint, Defendant Sobolewski has removed
the chain but continues to prevent and/or limit access to the Brown Parcel and the Gunn
Parcel by threatening to again block Plaintiffs' access to the Road.
COUNT I - ACTION TO QUIET TITLE
21. The averments set forth in paragraphs 1 through 20 are incorporated by reference
as if more fully set forth at length herein.
22. A portion of the First Sobolewski Parcel, and the entire Second Sobolewski
Parcel, the Brown Parcel, and the Gunn Parcel originated from a common deed. Copies
of the parent deed and the subsequent deeds showing the division of the Parcels are
attached hereto as Exhibit "F". The property which originated from a common deed
shall hereinafter be referred to as the "Common Deed Property." See Exhibit "E."
23. The Road also passes through a portion of the First Sobolewski Parcel which did
not originate from the common deed. This portion of the First Sobolewski Parcel is
hereinafter referred to as the "Non-Common Deed Property." See Exhibit "E."
24. The division of the Common Deed Property was created by a common grantor
(hereinafter the "Original Grantor.") See Exhibit "E."
25. The Original Grantor did not specify an easement which would permit access to
the Brown Parcel and/or the Gunn Parcel when the Common Deed Property was divided.
26. The use of the Brown Parcel and Gunn Parcel would not be possible without the
existence of an easement. Thus an easement by implication arose upon the division of
the Common Deed Property.

27. The easement by implication permits Plaintiff Brown and Plaintiff Gunn access to
the Road which passes through the Common Deed Property.
28. Defendant Sobolewski has willfully and wrongfully deprived and/or limited
Plaintiff Brown and Plaintiff Gunn's right to use the Road by placing a locked chain
across the Road.
29. Plaintiff Brown, by himself and his predecessors in interest, has had adverse,
open, continuous, notorious and uninterrupted use of the portion of the Road which
crosses the Non-Common Deed Property for more than twenty-one (21) years.
30. Plaintiff Gunn, by herself and her predecessors in interest, has had adverse,
open, continuous, notorious and uninterrupted use of the portion of the Road which
crosses the Non-Common Deed Property for more than twenty-one (21) years.
31. Plaintiff Brown and Plaintiff Gunn have obtained an easement by prescription of
the Road which crosses the Non-Common Deed Property due to their adverse, open,
continuous and uninterrupted use of the Road.
WHEREFORE, Plaintiff Brown and Plaintiff Gunn respectfully request that this Court
award the following relief:
(a) Issue an Order quieting title to the Road;
(b) Issue an Order requiring Defendant Sobolewski to remove the locked
chain across the Road;
(c) Enjoin any future obstruction by Defendant Sobolewski of Plaintiffs
use of the Road;
(d) Award Plaintiffs the costs of suit; and
(e) Award such other relief as the Court deems appropriate.

COUNT II IN THE ALTERNATIVE - ACTION TO QUIET TITLE
32. The averments set forth in paragraphs 1 through 31 are incorporated by reference
as if more fully set forth at length herein.
33. Plaintiff Brown, by himself and his predecessors in interest, has had adverse,
open, continuous, notorious and uninterrupted use of the portion of the Road which
passes through the First Sobolewski Parcel and the Second Sobolewski Parcel for more
than twenty-one (21) years.
34. Plaintiff Gunn, by herself and her predecessors in interest, has had adverse,
open, continuous, notorious and uninterrupted use of the Road which passes through the
First Sobolewski Parcel and the Second Sobolewski Parcel for more than twenty-one (21)
years.
35. Plaintiff Brown and Plaintiff Gunn have obtained an easement by prescription of
the Road due to their adverse, open, continuous and uninterrupted use of the Road.
36. Defendant Sobolewski has willfully and wrongfully deprived and/or limited
Plaintiff Brown and Plaintiff Gunn's right to use the Road by placing a locked chain
across the Road.
WHEREFORE, Plaintiff Brown and Plaintiff Gunn respectfully request that this Court
award the following relief:
(a) Issue an Order quieting title to the Road;
(b) Order Defendant to remove the locked chain across Road;
(c) Enjoin any future obstruction by Defendant Sobolewski of Plaintiffs use of
the easement over the Parcels;
(d) Award Plaintiffs the costs of suit; and

(e) Award such other relief as the Court deems appropriate.

probated in the Register of Wills OIBce in the County of Cumberland; and
WHEREAS, Harold E. Boyer and Charles L. Boyer qualified as Executors of the
Last Will and Testament of Florence M. Boyer, deceased, and Letters Testamentary were
issued by the Register of Wills in and for Cumberland County to them on April 15, 1971;
and
WHEREAS, upon a Petition being presented to the Orphan's Court of Cumberland
County by the aforesaid Executors, an Order of the said Court was made September 21,
1971, directing Harold E. Boyer, as one of the Executors of the Estate to convey to
Charles L. Boyer and Rachel E. Boyer, his wife, the real estate herein described;
WHEREAS, said Harold E. Boyer, Executor as aforesaid, by deed dated the 24" of
September, 1971, said deed recorded in the Office of the Recorder of Dads in and for
Cumberland County at CoAsle, Pennsylvania in Deed Boob "H", Volume 24, Page 463,
granted and coveyed unto Charles L. Boyer and Rachel E. Boyer, his wife.
UNDER AND SUBJECT to all restrictions and easements of record
TOGETHER with all and singular the improvements, ways, woods, waters,
watercourees, rights, liberties, privileges, hereditaments and appurtenances to the same
belonging or In anywise appes-Wrting; and the reversion and reversions, remainder and
remainders, rents, issues and profits thereof, and of every part and parcel thereof, AND
ALSO all the estate, right, title, interest, use, possession, property, claim and demand
whatsoever of the Grantors both in law and in equity of, in and to the premises herein

distance of 181.72 feet to an iron pin, said pin being the point of BEGINNING.

Grant Sobolewski and Denise M. Sobolewski, Grantors herein.
