CIVIL ACTION - LAW NO. JURY TRIAL DEMANDED COMPLAINT 1. Plaintiffs Rose M. Brown and Thomas S. Brown are wife and husband adult individuals and citizens of the Commonwealth of Pennsylvania, who reside at 5600 Plainview Road, Harrisburg, Dauphin County, Pennsylvania 17111. 2. The Defendant Radisson Penn Harris Hotel and Convention Center is operated and managed by Defendant HMC Hospitality Management Corporation which is a Texas Corporation which maintains its principle office at 17950 Preston Road, Suite, 710, Dallas, TX 75252. 3. Defendant Penn Lodge Partners, L.P. with Defendant Bridge Partners, general partner, own and operate the Radisson Penn Harris Hotel and Convention Center and maintain offices at 1150 Camp Hill Bypass, Camp Hill, Cumberland County, PA 17011. 424737 4. The facts and occurrences hereinafter related took place on or about February 20, 2008, at the Radisson Penn Harris Hotel and Convention Center at the intersection of U.S. Route 11 and Erford Road, Camp Hill, Cumberland County, Pennsylvania. 5. At that time and place, Plaintiff Rose M. Brown was a business invitee who was walking from the convention center under a covered roof to the hotel looking for a meeting room. 6. At that time and place, Plaintiff Rose M. Brown was a business invitee on Defendant's property and was owed a duty of reasonable care by the Defendants. 7. At that time and place, Plaintiff Rose M. Brown slipped and violently fell on ice which had formed from water dripping to the ground through the roof over the walkway which created a dangerous condition that was not obvious and not marked or identified and had been allowed to exist by the Defendant. 8. As a result from the ice forming on the sidewalk, Plaintiff Rose M. Brown pulled the back of her hamstring and hit her elbow on the ground. 9. Defendants Penn Lodge Partners, L.P. with Bridge Partners, general partner t/d/b/a Radisson Penn Harris Hotel and Convention Center; and HMC Hospitality Management Corporation, owed Plaintiff Rose M. Brown a duty to inspect, maintain, repair and warn about the dangerous condition, which they failed to do. 10. The aforementioned fall and all of the injuries and damages set forth hereinafter sustained by Plaintiff Rose M. Brown are the direct and proximate result of the negligent, careless, and reckless manner in which Radisson Penn Harris Hotel and Convention Center; Penn Lodge Partners, L.P. and Bridge Partners, general partner t/d/b/a Radisson Penn Harris Hotel and 424737 Convention Center; and HMC Hospitality Management Corporation maintained, repaired, warned, inspected the property as follows: (a) failing to properly inspect the property to discover that dangerous ice build up condition created by water dripping from the roof over the walkway and to make repairs or warn of the dangerous condition; (b) failing to post warning, barricades, signs, painting, or other means of warning of the dangerous condition and protecting the general public; (c) failing to clear accumulated ice from the sidewalk and/or walkway area; (d) failing to apply a melting or cindering agent to the patch of ice on the sidewalk and/or walkway; (e) failing to make repairs to the roof over the walkway to make it safe for persons such as Plaintiff Rose M. Brown to travel upon; (g) failing to take other action and precautions that a reasonably prudent property owner would have undertaken for the protection of the general public; and (h) failure to exercise the high degree of care that a business or landowner owes to business invitees utilizing the premises for its intended purpose. CLAIM I ROSE M. BROWN V. RADISSON PENN HARRIS HOTEL AND CONVENTION CENTER; PENN LODGE PARTNERS L.P. AND BRIDGE PARTNERS GENERAL PARTNER t/d/b/a RADISSON PENN HARRIS HOTEL AND CONVENTION CENTER, and HMC HOSPITALITY MANAGEMENT CORP. 11. Paragraphs 1 through 9 of Plaintiffs' Complaint are incorporated herein by reference. 12. Plaintiff Rose M. Brown has sustained painful and severe injuries which include but are not limited to pulled left hamstring and elbow pain. 424737 13. As a result of the aforementioned injuries, Plaintiff Rose M. Brown has incurred liability for medical treatment, medications, and similar miscellaneous expenses in an effort to restore herself to health, and claim is made therefor. 14. Because of the nature of her aforementioned injuries, Plaintiff Rose M. Brown has been advised, and therefore avers that she will incur similar expenses in the future, and claim is made therefor. 15. As a result of the aforementioned injuries, Plaintiff Rose M. Brown has and will continue to undergo physical and mental suffering, inconvenience in carrying out her daily activities, loss of life's pleasures and enjoyment, and claim is made therefor. 16. As a result of the aforementioned injuries, Plaintiff Rose M. Brown has been and in the future may continue to be subject to humiliation and embarrassment, and claim is made therefor. 17. Plaintiff Rose M. Brown continues to be plagued by persistent pain and limitation and has been advised, and therefore avers that her injuries are of a permanent nature, causing residual problems for the remainder of her lifetime, and claim is made therefor. WHEREFORE, Plaintiff Rose M. Brown demands judgment against Defendant Radisson Penn Harris Hotel and Convention Center; Penn Lodge Partners, L.P. and Bridge Partners, general partner, t/d/b/a Radisson Penn Harris Hotel and Convention Center; and HMC Hospitality Management Corporation in an amount in excess of Fifty Thousand ($50,000.00) Dollars exclusive of interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
