MEFFERD Living Trust Article Une Creation of My Trust Section 1. My Trust On April 4, 2003., I_created the VIOLET M. MEFFERD Revocable Living Trust, with VIOLET NI. MF,gFERD, the Trustmaker, and VIOLET M. MEFFERD, my initial Trustee. I now wish to restate that trust in its entirety. My Trustee shall remain: VIOLET M. MEFFERD My trust is a revocable living trust that contains my instructions for my own well- , being and that of my loved ones. All references to "my trust" or "trust," unless otherwise stated, shall refer to this Living Trust and the trusts created in it. All references to "Trustee" shall refer to my initial Trustee or Trustees, or their successor or successors in trust. When the term "T~ustmaker" is used in my trust, it shall have the same legal meaning as "Grantor," "Settlor," `"Trustor," or any other term referring to the maker of a trust. Notwithstanding anything in my trust to the contrary, when I am serving as a Trustee under my trust, I may act far and conduct business on behalf of my trust as a Trustee without the consent of any other Trustee. Section 2. Thee Name'of My Trust For convenience, my trust shall be known as the: VIOLET M: MEFFERD LIVING TRUST, dated Apri14, 2003 For purposes of beneficiary designations and transfers directly to my trust, my trust shalt be referred to as: 1-1 °~ VIOLET M. MEFFERD, sole Trustee, or her successors in trust, under the VIOLET M. MEFFERD LIVING TRUST, dated April 4, 2043, and any amendments thereto. In addition to the above descriptions, any description for referring to my trust shall be effective to transfer title to my trust or to designate my trust as a beneficiary as Long as that description includes the date of my trust, the name of at least one initial or successor Trustee, and any reference that indicates that assets are to be held in a fiduciary capacity. s 1-2 Article Two My Family The names of my children are: THEODORE C. MEFFERD TRUD>E SEAGRIST BONNIE SCHAEFER STEVEN MEFFERD All references to my children in this agreement are to these children, as well as any children subsequently born to me, or legally adopted by me. 2-1 Article Nine Distribution of My Trust Property Section 1. Division into Separate Shares The remaining trust property shall be divided into as many shares as shall be necessary to create one equal share for each of my then living children, and one equal share for each of my deceased children who has then living descendants. Section 2. Distribution of Trust Shares for TViy Living Children The share of each child then living shall be distributed as follows: a. Distribution of Trust Share for THEODORE C. MEFFERD The trust share set aside for 'THEODORE C. MEFFERD shall forthwith terrrunate and my Trustee shall distribute all undistributed net income and principal to THEODORE C. MEFFERD, free of the trust. 'THEODORE C. MEFFERD shall have the unlimited -and unrestricted general power to appoint, by a valid last will and testament or by a valid living trust agreement, the entire principal and any accrued and undistributed net income of his trust share as it exists at his death. In exercising this general power of appointment, THEODORE C. MEF'FERD shall specifically refer to this power. THEODORE C. MEFFERD shall have the sole and exclusive right to exercise the general power of appointment. This general power of appointment specifically grants to THEODORE C. MEFFERD the right to appoint property to his own estate. It also specifically grants to him the right to appoint the property among persons, corporations, or other 9-1 entities in equal or unequal proportions, and on such terms and conditions, whether outright or in trust, as he may elect. To the extent this general power of appointment is not exercised, my Trustee shall distribute the remaining trust property to the then living descendants of THEODORE C. IV~FFERD, per stirpes. If THEODORE C. MEFFERl.~ has no then living descendants, my Trustee shall distribute the balance of the trust property to my then living descendants, per stirpes. If I have no then living descendants, my Trustee shall distribute the remaining trust property as provided in Article Teri of this-agreement. b. Distribution of Trust Share for TRUDIE SEAGRIST The trust share set aside for TRUDIE SEAGRIST shall forthwith terminate and my Trustee shall distribute all undistributed net income and principal to TRUDIE SEAGRIST, free of the trust. TRLtDTE SEAGRIST shall have the unlimited and unrestricted general power to appoint, by a valid last will and testament or by a valid living trust agreement, the entire principal and any accrued and undistributed net income of his trust share as it exists at his death. In exercising this general power of appointment, TRUDIE SEAGRIST shall specifically refer to this power. TRUDIE SEAGRIST shall have the sole and exclusive right to exercise the general power of appointment. This general power of appointment specifically grants to TRUDIE SEAGRIST the right to appoint property to his own estate.' It also specifically grants to him the right to appoint the property among persons, corporations, or other entities' in equal or unequal proportions, and on such terms and conditions, whether outright or in trust, as he may elect. Distribution of Trust Share for BONNIE SCHAEFER The trust share set aside for BONNIE SCHAEFER shall forthwith terminate acid my Trustee shall distribute all undistributed net income and principal to BONNIE SCHAEFER, free of the trust.
