Rine, of 963 Ridge Road, Shippensburg, Pennsylvania, being of sound and disposing mind, memory and understanding, do hereby declare this to be my will, hereby revoking any and all former wills and codicils thereto by me heretofore made . I. III. I give the sum of $100,000.00 cash to my son, Douglas L. Rine. Iv. I give and devise my real estate situate at 963 Ridge Road, Shippensburg, Pennsylvania, to my daughter, Eileen D. Brenize. V. I give the sum of $30,000.00 cash to my son, J. Gary Rine. VI. In the event that there is insufficient funds in the estate to honor the bequests set forth in said paragraphs III and V, my home shall be distributed to Eileen D. Brenize upon payment by her of the sum of $50,000.00 to my son, Douglas L. Rine; however, no payment or bequest shall be made to my son, J. Gary Rine. ~~\ VII . ~ I give, devise and bequeath the residue of my estate of every nature and wherever situate to my children, namely Douglas L. Rine, Eileen D. Brenize, and J. Gary Rine, in equal shares, providing should Douglas L. Rine or Eileen D. Brenize predecease me or die on or before the thirtieth day following my death, their share would be distributed to their issue, per stirpes, living on the thirty- first day following my death. Should my son, J. Gary Rine, Page 2 predecease me or die on or before the thirtieth day following my death, his share shall be distributed as follows: one-third thereof to his wife, Virginia B. Rine, and two-thirds thereof to the children of Darrin G. Rine and Curtis J. Rine, equally, living at the time of my death. vziz. Any fiduciary under this will shall have the following powers in addition to those vested in them by law and by other provisions of my will applicable to all property whether principal or income, including property held for minors, exercisable without Court approval, and effective until actual distribution of all property: A. To retain any and all of the assets of my estate, real or personal, without regard to any principle of diversification of risk. B. To invest in all forms of property including stock, \ common trust funds and mortgage investment funds without restriction to investments authorized for Pennsylvania fiduciaries as they deem proper, without regard to any principle of diversification of risk. C. To sell at public or private sale, to exchange or to lease for any period of time any real or personal property and to give options for sales, exchanges or leases, for such prices and upon such terms or conditions as they deem proper. D. To allocate receipts and expenses to principal or income Page 3 or partly to each as they from time to time think proper. E. To compromise any claim or controversy. F. To distribute in cash or in kind or partly in each. G. To hold property in their names without designation of any fiduciary capacity or in the name of a nominee or unregistered. IX. In the event that anyone entitled to a share of my estate shall be under the age of twenty-three years at the time for distribution to such beneficiary, I constitute and appoint the Orrstown Bank, with principal offices in Shippensburg, Pennsylvania, as trustee of any property which passes either under this will or otherwise to said beneficiary. Said trustee shall in the trustee's sole discretion and without order of court, use principal as well as income from time to time as may appear to be cc, necessary for the beneficiary's welfare, comfort, medical care, C~ recreation, support and education, without responsibility to the beneficiary or to any person taking care of the beneficiary; and the remaining balance in the hands of said trustee shall be distributed to said beneficiary when the beneficiary attains the age of twenty-three years. If such beneficiary dies prior to attaining the age of twenty-three years, said trustee is authorized in the trustee's discretion to pay part or all of the beneficiary' s funeral expenses and the remaining balance in the hands of said Page 4 trustee shall be distributed to the beneficiary's personal representative . In the event the funds held by the trustee for any beneficiary become in the opinion of the trustee too small for proper and efficient administration, the trustee, in the trustee's sole discretion, may deposit such funds in a savings account in the name of the beneficiary. X. I direct that all taxes that may be assessed in consequence of my death of whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as a part of the expense of the administration of my estate. XI. I appoint my son, J. Gary Rine, as executor of this my will. ~\a Should my son predecease me, fail to qualify or cease to act, I appoint my son, Douglas L. Rine, as executor of this my will. XII.
