COMPLAINT
The Plaintiff, Nancy Lolas, by and through her attorneys,
SCHMIDT KRAMER PC, and hereby avers as follows:
THE PARTIES
1. The Plaintiff, Nancy Lolas, is an adult individual currently
residing at 10 Ashburg Drive, Mechanicsburg, Cumberland County,
Pennsylvania.
2. Defendant, Donna Digilio, is an adult individual currently
residing at 2 Irongate Court, Mechanicsburg, Cumberland County,
Pennsylvania.
FACTS
3. The facts which give rise to the cause of action occurred on
or about January 23, 2008 at about 12:45 pm at the intersection of
Hogestown Road and Mulberry Drive, Silver Spring Township,
Cumberland County, Pennsylvania, where a collision occurred between
an automobile operated by Donna Digilio and an automobile operated by
Nancy Lolas.
4. At the time of the above-referenced collision, Donna Digilio
was operating an automobile owned by 4 D's handy Service west on
Mulberry Drive and failed to stop at a stop sign.
5. At the aforementioned time and place, Plaintiff Nancy Lolas
was operating her automobile south on Hogestown Road-which was
controlled by no traffic control devices-and was hit by the Defendant's
car as she entered the intersection of Hogestown Road and Mulberry
Drive.
6. The collision and resulting injuries and damages are in no
way caused or contributed to by the Plaintiff and were solely caused by
the Defendant for the reasons set forth below.
COUNT I
Nancy Was v. Donna Digilio
NEGLIGENCE
7. Paragraphs 1 through 6 of the Complaint are incorporated
herein by reference and made a part thereof as if set forth in full.
8. The negligence, carelessness, and recklessness of the
Defendant, Donna Digilio, consisted of the following:
a. Operating her vehicle at an excessive rate of speed
under the circumstances and road conditions;

b. Failing to have her vehicle under proper and adequate
control;
C. Failing to apply her brakes in time to avoid the
collision with the Plaintiff;
d. Failing to keep a reasonable lookout for other vehicles
lawfully on the roadway;
e. Failing to operate her vehicle according to existing
traffic weather conditions and/or traffic controls;
f. Operating her vehicle in a manner so as to create a
dangerous situation for other vehicles on the roadway;
g. Failing to drive at a speed that enabled her to stop
within the assured clear distance ahead;
i. Violating 75 Pa.C.S.A. § 3323 which is negligence per
se.
9. As a direct and proximate result of the collision and
Defendant's negligence, Plaintiff, Nancy Lolas, sustained injuries to her
neck that may be permanent.
10. As a factual result of the accident, Plaintiff, Nancy Lolas, has
incurred medical expenses to date and will continue to incur medical
expenses into the future, and thus, a claim for these expenses is made.
11. As a factual result of the accident, Plaintiff, Nancy Lolas, has
undergone in the past, and will continue to undergo in the future, great
pain and suffering, and thus, a claim for these injuries is made.

12. As a factual result of the accident, Plaintiff, Nancy Lolas, has
been obliged to spend various sums of money and to incur various
expenses for the injuries that she has suffered and may continue to
incur the same in the future, and thus, a claim for these losses is made.
13. As a factual result of the accident, Plaintiff, Nancy Lolas,
suffered a loss of earnings and an impairment of her earning power and
capacity in the future, and thus, a claim for these losses is made.
14. As a factual result of the accident, Plaintiff, Nancy Lolas,
suffered a permanent diminution of her ability to enjoy life and life's
pleasures, and thus, a claim for these losses is made.
WHEREFORE, Plaintiff, Nancy Lolas, demands judgment against
the Defendant, Donna Digilio, in an amount in excess of the amount
requiring compulsory arbitration.
