Ss ~.. ~ `..,~ ~ _- 'r tG -- 1' .. _ =r`t ~ -, AND NOW, comes Petitioner, Guardian Elder Care Home and Community Services, LLC d/b/a Forest Park Health Center ("Petitioner"), pursuant to 20 Pa. C.SA. §§ 5512.2 and 5515, and respectfully represents that: 1. Petitioner, a domestic corporation licensed to do business in the Commonwealth of Pennsylvania, with its principal offices located at 1217 Slate Hill Road, Camp Hill, Pennsylvania 17011, operates a skilled nursing facility at which the incapacitated individual, Robert W. Sipe (`NVard"), is a resident. 2. On or about December 12, 2008, this Court adjudged the Ward to be a totally incapacitated person. See the Final Decree attached hereto as Exhibit "A." 3. On or about December 12, 2008, John Arthur Sipe, Sr. ("Guardian") was appointed as the Plenary Permanent Guardian of the Estate of the Ward. See Exhibit "A. ORIGINAL 4. The Guardian was asked to assist Petitioner in establishing Ward's eligibility for Medical Assistance benefits by effectuating a spend down of Wazd's resources pursuant to his appointment as Guardian of the Estate of Ward, and in response to the Medical Assistance notice denying Medical Assistance benefits. See Cumberland County Assistance Office Notice of Denial, attached hereto as Exhibit "B." 5. The Guardian has actively assisted in the partial spend down of Ward's excess resources; however, when verification of certain expenditures from Ward's M&T bank account was requested, the Guazdian became increasingly uncooperative. 6. Since December 15, 2009, the Guardian has failed to answer or return telephone calls from, or communicate in any way with Petitioner's skilled nursing facility with regard to important information regazding Wazd's missing financial resources, all of which were missing due to the Guardian's withdrawal of same. The Guazdian has also failed to respond to written correspondence regarding the withdrawals. See the December 22, 2009 Correspondence to the Guazdian and delivery confirmation, attached hereto as Exhibit "C." 7. The Guardian has failed to cooperate with Petitioner's request for assistance and verification in establishing Wazd's Medical Assistance eligibility, and continues to withdraw funds from Ward's bank account without remitting payment for the skilled nursing care Petitioner has provided and continues to provide to Ward. 8. The Guardian has written checks for "cash" from Ward's M&T bank account since January, 2009, equaling Eleven Thousand, Seven Hundred Twenty-Five ($11,725.00) Dollars, with no explanation or receipts for the purchases and none of these funds were paid to Petitioner for services provided to the Wazd. See Ward's M&T Bank Statement Withdrawals, attached hereto as Exhibit "D." 2 9. Despite the Guardian's failure to communicate with the Petitioner's skilled nursing facility, Ward remains a resident of the facility and the balance due to Petitioner for services rendered to Ward is steadily increasing each month, to an amount in excess of Ninety- Two Thousand ($92,000.00) Dollars at present. See the Ward's Current Invoice, attached hereto as Exhibit "E." 10. To address the increasing balance due on the Ward's account, Petitioner needs to establish his eligibility for Medical Assistance benefits; however, Petitioner cannot do so without the Guardian's cooperation in the provision of certain information and verifications to the County Assistance Office, and proof of where the aforementioned Eleven Thousand, Seven Hundred Twenty-Five ($11,725.00) Dollars was spent. 11. As the Guardian is unwilling to cooperate in the Medical Assistance benefits application process, and may be misappropriating Ward's funds, Petitioner requests an Emergency Review Hearing pursuant to 20 Pa. C.S.A. § 5512.2. 12. A review hearing is warranted under 20 Pa. C.S.A. §5512.2 because the Plenary Permanent Guardian of the Estate of Ward, has failed to act in the best interests of the Ward and has withdrawn Eleven Thousand, Seven Hundred Twenty-Five ($11,725.00) Dollars in cash with no record of payment to Plaintifffor Ward's medical care or any other explanation. 13. The emergency nature of this petition is based on a Fair Hearing before the Bureau of Hearings and Appeals scheduled for January 25, 2010, wherein Ward's eligibility will be determined. Additionally, there is the ultimate concern that the Guardian will confinue to misappropriate Ward's funds. 3 14. Petitioner requests a judicial determination that the Guardian has failed to act in the best interests of Ward by failing to respond to communications from Petitioner's skilled nursing facility with regard to important financial verifications needed to establish Ward's Medical Assistance benefits, including documentation regarding the withdrawals of Ward's funds in the amount of Eleven Thousand, Seven Hundred Twenty-Five ($11,725.00) Dollars. 15. The wasting or mismanaging of the estate is grounds for removal pursuant to 20 Pa.C.S. § 3182, and is applicable herein by and through 20 Pa.C.S. § 5515. 16. Additionally, the Guardian has failed to file an a report with the Clerk of the Orphans' Court containing Ward's assets, investments, receipts, and disbursements, as required in 20 Pa.C.S. § 5521(c). 17. Grounds for removal of a guardian include failing to perform any duty imposed by law. See 20 Pa.C.S. §§ 3182(1), 5515. 18. Petitioner further requests that the Guardian be compelled to provide an accounting for his fiduciary actions, especially with regard to the Eleven Thousand, Seven Hundred Twenty-Five ($11,725.00) Dollars that was withdrawn. 19. Additionally, Petitioner requests that this Court appoint Brian D. Brooks d/b/a Pennsylvania Guardianship Association, 117 S.W. End Avenue, P.O. Box 7295, Lancaster, Pennsylvania 17604, to replace the current Guardian of the Estate of Ward. 20. Brian D. Brooks d/b/a Pennsylvania Guardianship Association does not have any interests adverse to the Ward, and he is otherwise qualified to act as Guardian because he currently handles numerous guardianship matters similar to the one at hand. See Consent of the proposed Successor Plenary Guardian attached hereto as Exhibit "F." 4 WHEREFORE, Petitioner prays your Honorable Court promptly schedule a review hearing to determine whether the existing Guardianship Order shall be modified to remove John A. Sipe, Sr. as Guardian of the Estate of Robert W. Sipe, and appoint as the Successor Guardian of the Estate, Brian D. Brooks d/b/a Pennsylvania Guardianship Association. You indicated to me that you would take receipts for such purchases to Forest Pazk Health Care Center, our client, on Saturday, December 12, 2009. To date, Forest Park has not received any receipts from you. I have since spoken to the County, and in addition to the expenditures from C-ctober, 2009, fine County also requires receipts for all purchases made with checks written from Robert's checking account from January 2009 through July 2008. 'The checks written during that time period are in excess of $15,000.00. IE you fail to provide the requested receipts to prove the cash withdrawals and expenditures were spent for Robert's benefit and/or his medical care, we will pursue civil litigation against you wherein a judge will require proof of exactly how Robert's money was spent.
