1. Plaintiff is Citimortgage, Inc., s/b/m To ABN Amro Mortgage Group, Inc..
2. Defendant is Matthew A. Prazenica Or Occupants.
3. Plaintiff is the record owner of premises located at 702 Highland Avenue, Mount Holly Springs, PA
17065 , a legal description of which is attached.
4. Plaintiff became the owner of said premises as a result of the foreclosure and judicial sale by the
Sheriff of Cumberland County, on December 9, 2009, as evidenced by the Sheriff s deed recorded
January 8, 2010 in the Office of the Recorder of Cumberland County in instrument # 201000754.
5. Plaintiff, by virtue of the above, is the record owner of said premises, and is entitled to possession
thereof. The defendant is occupying the said premises without right and so far as the plaintiff is
informed, without claim of title.
6. Plaintiff has demanded possession of the said premises from the said defendant who has refused to
deliver up possession of same. n
WHEREFORE, plaintiff seeks to recover possession of said

ALL THOSE TWO LOTS OR PARCELS OF LAND situate in the Township of South Middleton, County
of Cumberland and State of Pennsylvania, being Lots Nos. 33 and 34 in a Plan of Lots
known as 'Mt. View Addition', the same being of record in the office of the Recorder of
Deeds for Cumberland County in Plan Book 3, Page 86, and more particularly described as
follows:
Tract No. 1
BEGINNING at a point on the East side of Highland Ave., said point being the boundary
line of Lots 34 and 35 and approximately 150 feet Northerly along said Highland Ave.,
from the Northeast point of intersection of Highland Ave. and Mt. View Drive; thence
Easterly along the line of Lots 34 and 35, One Hundred Fifty Feet to a point; thence
Northerly along the line of Lots 34 and 74 to a point on Woodland Ave., a distance of
approximately 50 feet; thence Westerly along the South line of Woodland Ave.,
approximately One Hundred Fifty feet to a point at the intersection of Woodland Ave. and
Highland Ave.; thence in a Southerly direction with Highland Ave, approximately 100 feet
to the place of BEGINNING.
HAVING thereon erected a 6 room brick house with bath and attached garage.
AND BEING the same premises which Kenneth W. Hess and Leah E. Hess, his Wife, by Deed
dated September 22, 1953 and recorded September 22, 1953, in the Office of the Recorder
of Deeds, in and for Cumberland County, Pennsylvania in Deed Book 'J', Volume 15, Page
399, granted and conveyed unto Walter H. Kutz and Helen E. Kutz, his wife. The said
Walter H. Kutz died on June 25, 1978 and, by operation of law, title to said premises
vested solely in Helen E. Kutz, his wife, Grantor herein, who died on July 15, 1998.

ALL THAT CERTAIN lot of ground situate in the Township of South Middleton, County of
Cumberland and State of Pennsylvania, bounded and described as follows:
BEGINNING at a point in the Eastern side of Highland Avenue, which point is a corner of
Lot No. 34 on the hereinafter mentioned Plan of Lots; thence in an Eastwardly direction
along the line of Lot No. 34, a distance of 150 feet to a point in line of Lot No. 74;
thence in a Southerly direction along part of Lot No. 74, a distance of 50 feet to a
point in line of land of Lot No. 36; thence in a Westwardly direction along the line of
Lot No. 36, a distance of 150 feet to a point in the Eastern side of said Highland
Avenue; thence in a northwardly direction along the Eastern side of said Highland Avenue,
a distance of 50 feet to a point, the place of BEGINNING.
BEING all of Lot No. 35 on that certain Plan of Lots laid out and adopted by M.L. Gulden,
said Plan being recorded in the Office of the Recorder of Deeds in and for the County of
Cumberland in Plan Book No. 3, page 86, said Plan of Lots being known as 'Mountain View
Addition'.
AND BEING the same premises which Ira C. Gleim and Lou E. Gleim, his wife, by Deed dated
May 27, 1954 and recorded in the office of the Recorder of Deeds, in and for Cumberland
County, Pennsylvania in Deed Book 'U', Volume 15, Page 69, granted and conveyed unto
Walter H. Kutz and Helen E. Kutz, his wife. The said Walter H. Kutz died on June 25, 1978
and, by operation of law, title to said premises vested solely in Helen E. Kutz, his
wife, Grantor herein, who died on July 15, 1998.

I hereby state that I am the attorney for the Plaintiff in this eviction action and is authorized to make this
verification. The statements made in the foregoing Civil Action - Ejectment are correct to the best of my
knowledge, information, and belief. I was the attorney for the Plaintiff or Plaintiffs predecessor in interest in the
underlying foreclosure action. I am with the law firm on the writ of execution, and my law firm or an agent of my
firm purchased the property on behalf of the Plaintiff by bidding on the property at the sheriff s sale. I am making
this verification rather than a representative of the Plaintiff because I have personal knowledge of the purchase of
this property at sheriffs sale.
The undersigned understands that this statement is made subject to the penalties of 18 Pa.C.S. §4904
relating to unsworn falsification to authorities.

Rink, 1561 Holly Pike, Mount Holly Springs, Cumberland County, Pennsylvania 17065 its contents and at
the same time handing to him personally the said true and correct copy of the same.

diligent search and inquiry for the within named defendant to wit: Occupant of 702 Highland Avenue,
Mount Holly Springs, PA 17065, but was unable to locate them in his bailiwick. He therefore returns the
within Complaint in Ejectment as not found as to the defendant Occupant. Matthew A. Prazenica, current
owner is the only occupant at 702 Highland Avenue, Mount Holly Springs, PA 17065.
