Report from Guardian of Person

On March 14, 2006 Judge Kevin Hess appointed the Cumberland County Office of
Aging Emergency Plenary Guardian of Person for Nancy Hoerner and on April 6, 2006
the agency was named Nancy's Permanent Plenary Guardian. On April 18, 2006,
following a brief stay in the Behavioral Health Unit of Chambersburg Hospital, Nancy
was admitted to the South Mountain Restoration Center, South Mountain, PA where she
is currently staying.
Nancy was diagnosed with chronic schizophrenia, adjustment disorder with disturbance
of conduct, and cognitive disorder which was more recently diagnosed as alzheimer's
disease.
Nancy has had occasional disagreements with other residents but usually the facility's
staff has done a good job in addressing these issues. At one point Nancy was given a
private room on the same floor because of continued negative interactions with her
room mate. She seems to be much happier with this arrangement. She does have a
history of hitting the caregivers for no apparent reason as attention seeking behavior.
Because South Mountain Restoration Center is in Franklin County our office began to
pursue the transfer of guardianship to Franklin County. Soon after that time -Nancy was
diagnosed with possible breast cancer as a result of a mammogram. Initially she reused
to go for a biopsy. It was decided, therefore, that the transfer should be put on hold until
these issues were resolved.
Ms. Hoerner eventually agreed to the biopsy and she was found to be negative of
cancer but atypical cells were found. She was put on amoxophen for 5 years.
Since these issues were resolved, transfer proceedings were resumed. On
December 22, 2009 Judge Hess signed the court order transferring her guardianship to
the Franklin County Area Agency on Aging. Attached is a copy of the court order.

AND NOW, to wit, this 2 Z ~ day of December, 2009, after reviewing the Petition

for Transfer of Guardianship, it is Ordered and Decreed that the Appointment of the Area
Agency on Aging, in and for Cumberland County, Pennsylvania as Permanent Plenary
Guardian of the Person and Estate of Nancy Hoerner, an incapacitated person, is terminated
a.nd Franklin County Area Agency on Aging, a guardianship support agency as defined at 20
Pa. C.S. §5551, et seq., with offices at 600 Norland Avenue, Suite 11, Cha~nbersburg,
Franklin. County, Pennsylvania 17201, is appointed as Successor Permanent Plenary
Guardian of the Person and Estate of Nancy J. Hoerner, an incapacitated person.
Franklin County Area Agency on Aging, as Successor Guardian, shall be entitled
to receive payment of a fee for services rendered, as Permanent Plenary Guardian of th.e
Person and Estate o.f Nancy J. Roemer, subject to a maximum of 10% of Nancy J.
Hoerner's gross monthly income or $100.00 per month, whichever is Less.
