I, WILLIAM J. FLICKINGER, of 329 Salt Road, Enoia, Cumberland
County, Pennsylvania, being of sound and disposing mihd, memory and
understanding, do make, publish and declare this to be my Last Will
and Testament, hereby revoking all Wills and codicils heretofore
made by me.
ITEM I. I direct that all my debts and funeral expenses,
including my cemetery lot and gravemarker and all expenses of my
last illness, shall be paid from my residuary estate as soon as
practicable after my death as part of the expense of the
administration of my estate.
ITEM II. I devise and bequeath all of my estate of every
nature and wherever situate equally unto my daughters, Margaret
Lydia Ertter and Sylvia Carol Lahr, and their issue per stirpes.
ITEM III. I direct that my estate shall retain my real estate,
allowing Georgianna Tobias the right and privilege of residing in
the residence thereon. She shall continue to have the privilege of
residing in that house until her death on the following terms and
conditions: (1) She shall be responsible for paying all costs of
maintenance of the dwelling and real estate, real estate taxes,
utilities, and any other costs associated with the use of the
residence and the real estate on which it is located. (2) Her
right to reside there shall terminate if, for any thirty (30) days
(they need not be consecutive) in any sixty (60) day period, she
does not live in the residence or if she becomes a resident in a
nursing home for a minimum period of six (6) months.
ITEM IV. I direct that any and all Inheritance, Estate and
Transfer taxes imposed upon my estate passing under my Will or
otherwise, shall be paid out of the principal of my residual
estate.
ITEM V. I appoint my daughter, Margaret Lydia Ertter,
Executrix of this my Last Will and Testament. In the event of her
renunciation, death, resignation or inability to act for any reason
whatsoever, I appoint my daughter, Sylvia Carol Lahr, Executrix of
this my Last Will and Testament. I relieve my Executrix from the
necessity of posting security in connection with her duties as such
in any jurisdiction in which she may be called upon to act.
IN WITNESS WHEREOF, I have hereunto set my hand to this my

For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 3%
[72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. §9116 (a) (1.1) (ii)].
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stePparent of the child is 0% [72 P.S. §9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. {}9116(12) [72 P.S. {}9116(a)(1)].
The tax rate imposed on the net value of transfers to ~ for the use of the decedent's siblings is 12% [72 RS. §9116(a)(1.3)]. A sibling is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

D~'~INITION OF MARKETVALUE: The most probable price which a property should bring in a competitive and open
market under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeable and assuming
the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date
and the passing of title from seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both
parties are well informed or well advised, and each acting in what he considers his own best interest; (3) a reasonable time
is allowed for exposure in the open market; (4) payment is made in terms of cash in U.S. dollars or in terms of financial
arrangements comparable thereto; and (5) the price represents the normal consideration for the property sold unaffected by
special or creative financing or sales concessions* granted by anyone associated with the sale.
*Adjustments to the comparebles must be made for special or creative financing or sales concessions. No adjustments are
necessary for those costs which are normally paid by sellers as a result of tradition or law in a market area; these costs are
readily identifiable since the seller pays these costs in virtually all sales transactions. Special or creative financing adjustments
can be made to the comparable property by comparisons to financing terms offered by a third party institutional lender that
is not already involved in the property or transaction. Any adjustment should not be calculated on a mechanical dollar for
dollar cost of the financing or concession but the dollar amount of any adjustment should approximate the market's reaction
to the financing or concessions based on the appraiser's judgment.
CERTIFICATION AND STATEMENT OF LIMITING CONDITIONS
CERTIFICATION: The Appraiser certffies and agrees that:
1 .The Appraiser has no present or contemplated future interest in the property appraised; and neither the employment to
make the appraisal, nor the compensation for it, is contingent upon the appraised value of the property.

I. PURPOSE OF THE APPRAISAL The purpose of this report is to estimate the market value of the subject property, as
defined herein. The estimate of market value is to be used solely by the client as a basis for lending decisions or portfolio
management.
II. SCOPE OF THE APPRAISAL The following steps were followed in arriving at the final estimate of value included in the
appraisal report of the subject property:
1. An investigation was made to determine market trends, influences and other signifisent factors pertinent to the subject
property.
2. A physical inspection of the property was performed. Although due dilligence was exercised while at the subject property,
the appraiser is NOT an expert in such matters as pest control, structural engineering, hazardous waste, or construction etc.
and no warranty is given or implied as to these or other elements outside of analysis of market data. Inspections by various
professionals within these fields may be recommended with the final estimate of market value subject to their findings.
3. A more detailed review of the collected data was then performed with the most relevant factors extracted and considered.

public records. Market factors were weighted and their influence on the subject propen'y was determined. A highest and best
use analysis was done on the subject property.

X. SELF CONTAINMENT This appraisal report is intended to be a sell contained document containing all information
necessary to enable a reader to understand the appraiser's opinion. Any third party studies referred to, such as pest control,

A refund of a tax credit, which was not requested on the Tax Return, may ba requested by completing an "Application
for Refund of Pennsylvania Inheritance and Estate Tax" (REV-1313). Applications ara available at the Office
of the Register of Hills) any of the Z3 Revenue District Offices) or by calling the special 24-hour
answering service for forms ordering: 1-800-362-Z050; services for taxpayers with special hearing and / or
speaking needs: 1-800-447-30Z0 (TT only).
Any party in interest not satisfied with the appraisement, allowance, or disallowance of deductions, or assessment
of tax (including discount or interest) as shown on this Notice must object within sixty (60) days of receipt of
this Notice by:

--election to have the matter determined at audit of the account of the personal representative, OR
--appeal to the Orphans' Court.

Phone (717) 787-650S. See page S of the booklet "Instructions for Inheritance Tax Return for a Resident
Decedent" (REV-IS01) for an explanation of administratively correctable errors.
If any tax due is paid within three (3) calendar months after the decedent's death, a five percent (SI) discount of
the tax paid is allowed.
The 15Z tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January 18, 1996, the first day after the and of the tax amnesty period. This non-participation
penalty is appealable in the same manner and in the the same time period as you would appeal the tax and interest
that has been assessed as indicated on this notice.
Interest is charged beginning with first day of delinquency, or nine (9) months and Dna (1) day from the date of
death, to the date of payment. Taxes which became delinquent before January 1~ 198Z bear interest at the rate of
six (6X) percent per annum calculated at a daily rate of .000164. Ali taxes which became delinquent an and after
January 1, 19&Z will bear interest at a rata which will vary from calendar year to calendar year with that rate

TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of SYLVIA CAROL LAHR respectfully states that:
1. William J. Flickinger, the decedent, died on January 24,2004, a resident of 329
Salt Road, Enola, East Pennsboro Township, Cumberland County, Pennsylvania,
leaving a Will dated May 3,1995, a copy of which is attached hereto and marked
Exhibit "A".
2. Letters Testamentary were granted to Margaret Lydia Ertter, of HRC Box 445,
Scotia, Pennsylvania 19354, by the Register of Wills of Cumberland County in
February or March of 2004.
3. Petitioner is a party in interest in the Estate, being a beneficiary under Item II of
the Will, in that she is one of the decedent's two daughters to which the Will
directs that all assets of the estate be divided equally.
4. More than six months have elapsed since the first complete advertisement of the
Grant of Letters, and as of May 2,2006 no account of the Executrix has been filed.
5. Death tax closing letter has been received from the Department of Revenue of the
Commonwealth of Pennsylvania.
6.
More than two years have elapsed since the death of the decedent, and there is
no reason that an account should not be filed, the Estate terminated and
distribution completed.

7. The Executrix has failed to provide Petitioner with an account of her
administration despite the request that she do so.
8. The Executrix has failed to provide a Schedule of Proposed Distribution that

The petition of Margaret Ertter, Executrix of the estate of
William J. Flickinger, deceased, respectfully represents:
(a) That decedent died January 24, 2001 leaving a will.
(Exhibit "A") Letters of Administration were granted to Margaret
Ertter on January 29, 2004.
(b) The decedent was not survived by a spouse.
(c) The names of all legatees and the amounts and character of
their interests are as follows:

there are no children born or adopted by decedent thereafter.
(j) No questions require adjudication nor do any part or parts
of the will require interpretation.
(k) The inventory and aEpraisement of the estate amounting to
$118/260.30 was filed on ~vt a 7 / 2006.
(1) The estate is subject to the payment of inheritance tax to
the State of pennsylvania and the same has been paid in full.
Attached as exhibit C is the Statement of Account from the
Department of Revenue.
(m) The notice of the granting of Letters Testamentary was
published in the Patriot-News newspaper on the 13th/20th / and 27th of
March 2004 (Exhibit "D") and in the Cumberland County Journal on the
19th/26th and 2nd of April 2004 (Exhibit "E").
(n) No share of any party has been assigned or attached.
WHEREFORE your Petitioner asks distribution be awarded to the

ITEM I. I direct that all my -c debts and funeral expenses,
including my cemetery lot and gravemarker and all expenses of my
last illness, shall be paid from my residuary estate as soon as
practicable after my death as part of the expense of the
administration of my estate.
ITEM II. I devise and bequeath all of my estate of every
nature and wherever situate equally unto my daughters, Margaret
Lydia Ertter and Sylvia Carol Lahr, and their issue per stirpes.
ITEM III. I direct that my estate shall retain my real estate,
allowing Georgianna Tobias the right and priv~lege of residing in
the residence thereon. She shall continue to have the privilege of
residing in that house until her death on the following terms and
conditions: (l) She shall be responsible for paying all costs of
maintenance of the dwelling and real estate, real estate taxes,
utilities, and any other costs associated with the use of the
residence..,. and the real estate on which it is located. (2) Her
right to reside there shall terminate if, for any thirty (3D) days
(they need not be consecutive) in any sixty (60) day period, she
does not live in the residence or if she becomes a resident in a
nursing home for a minimum period of six (6) months.
