PETITION TO RENDER INVENTORY AND ACCOUNT
AND NOW, this 25th day of January, 2010, comes the Petition of Bernadine Wiley
respectfully representing that:
1. Petitioner Bernadine Wiley is the daughter of Decedent and resides at 718 S. Ankeny Blvd.
Apt. 132, Ankeny, Iowa 50023.
2. Harold F. Wiley, Sr. ("Decedent"), died on November 4, 2008.
3. At the time of Decedent's death, his family or principal residence was 2258 Pine Road,
Newville, Cumberland County, Pennsylvania.
4. Prior to Decedent's death he executed his Will, dated December 2Q, 2007, a copy of which is
attached as Exhibit "A", in which Will he appointed his daughter, Peggy L. Wiley-Nieves, as
his Executrix.
5. Decedent was survived by five children, the Petitioner, Peggy L. Wiley-Nieves, a/k/a Peggy
L. Nieves, Mary M. Wiley-Arbegast, Harold F. Wiley, Jr., and David Wiley.
6. A Petition for Probate and Grant of Letters was filed by Executrix on November 14, 2008,
stating that Decedent owned property with an estimated value of $162,000.00 at the time of
his death.
7. A Certification of Notice under Rule 5.6(a) was filed on December 10, 2009, stating that
Notices to the Beneficiaries had been sent on December 10, 2009. However, the
beneficiaries did not receive the required Notice. A copy of the Certification of Notice under
Rule 5.6(a) is attached hereto as Exhibit "B".
8. The Executrix has failed to advertise the estate in the Cumberland Law Journal.
9. The Executrix has failed to file an Inheritance Tax Return within nine months of Decedent's
death.
10. The Executrix has failed to pay Inheritance Tax on the estate.
WHEREFORE, Petitioner requests your Honorable Court enter an Order directing Peggy L.
Nieves to publish the estate in the Cumberland Law Journal, file an inheritance tax return, and
provide an inventory and account of the estate.
