H. Standardly accepted administrative fee percentages are calculated on the basis of the
estate in its entirety, collected and outstanding amounts. Accordingly, the basis for fee
calculation for both the personal representative and attorney is the sum of the Schedule
"E" amounts for cash in-hand and suspended amounts yet to be collected:
$3,088.02 + $618,164.02 = $621,252.04.
I. .Bertha devised her estate to the two children of her deceased brother George
Offenberger:
1. George W. Offenberger, who sometimes appends his name with a
"Sr." or "Jr." designation... depending. I believe he also has a son named
George. Bertha's father was another George Offenberger. Confusion is
apparently relegated solely to Bertha's nephew and his son, possibly of the salve
name, because Bertha's father is deceased and her brother got
electrocuted on a utility pole years ago.
2. Thelma Offenberger Gariano (also "Offenburger"), who died October 13,
2002, in New Mexico. Her three children accordingly become joint-heirs
of her portion of Bertha's estate.
I have tried to identify and clarify the "untidy" aspects of this return; hopefully I've been
