THIS AGREEMENT made this Ii day of ~:~]f~.~'~ 'i,~,~ 2001, by and between
D. CULLY, INC., D/B/A C & C CONSTRUCTION, A Pennsylvania Corporation,
hereinafter referred to as Contractor,
AND
RONALD KUHN, II AND HEATHER KUHN, husband and wife, hereinafter referred to
as Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Dickinson Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully described
in Exhibit "A" which is attached hereto and made a part hereof known as 188
Cold Springs Road, Dickinson Township, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for an in consideration of the sum of ($1.00) Dollar fo Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, arid the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot
of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressJy waive and relinquish
the right fo have, file, and maintain any mechanic's liens or claims against the
said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

same for the purposes therein contained.

himself to be the Secretary of D. Dully, Inc. d/b/a C & C Construction and that
he as such Secretary being authorized to do so, executed the foregoing
instrument for the purposes therein contained by signing the name of the said
Corporation by himself as such Secretary.

Exhibit A
ALL that certain tract of land situate in the Township of Dickinson, Cumberland
County, Pennsylvania, bounded and described as follows, to wit:
TRACT 1: BEGINNING at a point in the center of a bridge along the Cold Springs
Road and joining the land of The Mount Holly Water Company and on line of land
of William Ross Wolfe; thence by land of said William Ross Wolfe in a
northwestwardly direction 160 feet, more or less, to an iron pin; thence by same in a
southwestwardly direction 150 feet, more or less, to an iron pin; thence by same in a
southeastwardly direction 160 feet, more or less, to a point in the center of said Cold
Springs Road; thence by same in a northwardly direction along the center of the
said Cold Springs road 150 feet, more or less, to the Place of BEGINNING.
TRACT 2: BEGINNING at a point in the center of the present Cold Spring Road,
which point is a corner of land of William A. Grissinger, et ux; thence by the center
of the present Cold Spring Road in a northeasterly direction 229 feet, more or less,
to a point in the center of the present Cold Spring Road, which point is a corner of
land of Ariel F. Dubbs; thence by land of Ariel F. Dubbs and continuing along land
of William Ross Wolfe, et ux, in a northwesterly direction 462 feet, more or less, to a
pile of stone, which is corner of line of the said William Ross Wolfe, et ux, and on
linc of land of William Nailor; thence along land of William Nailor in a southerly
direction 190 feet, more or less, to a pile of stone, which is an old established corner
of land of Donald Barrick William Naiior and William A. Grissinger, et ux; thence
along land of William A. Grissinger, et ux, in a southeasterly direction 315 feet,
more or less, to a point in the center of the present Cold Spring Road, the place of
BEGINNING, and being improved with a one story ranch type dwelling house.
