BROWN Owners V THE McNAUGHTON COMPANY Contractor :IN THE COURT OF COMMON PLEAS OF :CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, Craig R. Kreider and Deborah L. Brawn, (OWNERS), are about to execute contemporaneously herewith a contract with The McNaughton Company, (CONTRACTOR), for the execution of a home situate in Upper AllenTownship, Cumberland County, Pennsylvania, more particularly bounded and described on the attached Exhibit "A'. NOW, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to be paid to Contractor, it is agreed that no lien shah be filed against the building by the Contractor, or any Subcontractor, nor by any of the materialmen or workmen or any person for any labor, or materials purchased, or extra labor or mterials purchased for the erection of said building, the fight to file such liens being expressly waived. ~ WITNESS our hands and seals the ~,~ ~ day of /Lt_~. ~ ,2004. Brown The McNaughton Company BY~~'~ra~pr LEGAL DESCRIPTION ALL that certain piece, parcel or lot of land situate in Upper Allen Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Eastern right-of-way line of Canterbury Drive (50.00 feet wide), said point being located at the Southwestern corner of Lot No. 164; thence along the Southern boundary line of Lot No. 164, South 69 degrees 40 minutes 06 seconds East, for a distance of 176.58 feet, to a point on the Eastern dedicated right-of-way line of Gettysburg Pike (T-621) (60.00 feet wide); thence along said Eastern dedicated right-of- way line of Gettysburg Pike, South 39 degrees 19 minutes 58 seconds West, for a distance of 150.35 feet, to a point in line of lands now or formerly of the McNaughton Company; thence along said other lands of McNaughton, North 51 degrees 04 minutes 01 seconds West, for a distance of 157.16 feet, to a point on the Eastern right-of-way line of Canterbury Drive (50.00 feet wide), thence along said Eastern right-of-way of Canterbury Drive, North 38 degrees 56 minutes 00 seconds East, for a distance of 38.20 feet, to a point on the arc of a circle curving to the left, with a radius of 175.00 feet, and an arc length of 56.82 feet, to a point and the place of BEGINNING. This piece, parcel or lot of land is known and numbered as Lot No. 163 on the Revised Final Subdivision Plan for Canterbury Estates, Phases IX and X, which is recorded in Cumberland County in Plan Book 83, Page 91.
