Kodak, Esquire, Kodak & Imblum, P.C., brings this action against the Defendants to recover possession of a 2003 GMC Sierra 2500 and in furtherance thereof, sets forth the following: 1. The Plaintiff, Cornerstone Federal Credit Union, is a federally chartered Credit Union organized and existing under Federal laws, with its principal office and place of business at 5 East Gate Drive, Carlisle, Cumberland County, Pennsylvania 17015. 2. The Defendant, Kenneth R. Yohn, is an adult individual with an address of 155 D Street, Carlisle, Cumberland County, Pennsylvania 17013. 3. The Defendant, Maryann Yohn, is an adult individual with an address of 155 D Street, Carlisle, Cumberland County, Pennsylvania 17013. On or about July 3, 2008, the Defendants did enter in a Loanliner Agreement with Plaintiff for the purpose of the financing of a 2003 GMC Sierra 2500, Vehicle Identification No. 1GTHK29G33E190408 . A true and correct copy of said Loanliner documentation is attached hereto, marked as Exhibit "A" and made a part hereof. 5. The Contract between the Parties was formed and accepted at Carlisle, Cumberland County, Pennsylvania. 6. By the terms of the Loanliner Agreement herein found at Exhibit "A", Plaintiff maintained a security interest in the aforesaid vehicle. 7. As further evidence of Plaintiff's security interest in the vehicle, a true and correct copy of the Certificate of Title for a Vehicle issued by the Commonwealth of Pennsylvania for the 2003 GMC Sierra 2500, clearly setting forth the first lien in favor of Plaintiff. Said title copy is marked as Exhibit "B" and made a part hereof. 8. Defendants have defaulted under the terms of the Loanliner by failing to make monthly payments when due and owing. 9 The vehicle in question, due to Plaintiffs lack of knowledge as to its condition and mileage, has an unknown retail value. Defendants have failed and refused, despite repeated demands from Plaintiff, to pay the balance due under the Loanliner Agreement and are, in fact, delinquent from the date of May 28, 2009, as set forth on a true and correct copy of Plaintiff's Member Inquiry attached hereto, marked as Exhibit "C" and made a part hereof. 10. Defendants, despite demands from Plaintiff and its repossession agents, have failed or refused to deliver possession of the vehicle in question to the Plaintiff and have, in fact, concealed the vehicle and kept same locked away from Plaintiff and Plaintiffs repossession agents. WHEREFORE, Plaintiff demands Judgment of possession, together with reasonable attorney's fees, interest and all costs, including costs of attempted repossession.
