Dear Mr. Church:
The Department of Revenue, Office of Chief Counsel, received the Appeal of Pennsylvania
Inheritance Tax Determination, filed on behalf of the above-referenced Estate. The Estate
appeals the Department's assessment of inheritance tax upon the value of a limited partnership in
which decedent owned an interest. The Department appraised the property at its full value,
disallowing any minority or lack of marketability discount.
As we discussed, the Department is willing to settle this appeal with no further involvement from
the Court. The Department agrees that the partnership is entitled to both a minority and lack of
marketability discount. For purposes of settlement only, the Department will agree to reduce its
assessment of additional inheritance tax to $8,431.25. If the Estate agrees to these terms, the
Department will issue a record adjustment that reflects that amount due on the account of the
Estate. If the Estate pays that amount by January 29, 2010, the accrued interest also due is
$476.01.
If the Estate agrees to these terms, I will forward a draft stipulation to settle the matter, for filing
with the Court.
