Rudge and Beth Ann Rudge, hereinafter called the Owner, is about to execute contemporaneously with Home Designs Unlimited, LLC of P.O. Box 387, New Kingston, PA 17072, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as Lot #16 107 Bellows Drive, South Middleton Township, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which Brian W. Rudge and Beth Ann Rudge are the title holder of record, as more particularly described in Deed Book and Robe, January 28, 2010, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. File No. 09-245 ALL THAT CERTAIN lot or piece of ground situate in South Middleton Township, County of Cumberland, Commonwealth of Pennsylvania, bounded and described in accordance with a Final Subdivision Plan for Old Forge Station, dated July 15, 2008 and recorded in the Office of the Recorder of Deeds in and for Cumberland County as Instrument Number 200827999 BEGINNING at a point at the corner of Lot 15 of the aforementioned Plan, thence North 41 degrees 05 minutes 15 seconds East 248.09 feet to a point at the corner of of Lot 15; thence South 86 degrees 57 minutes 10 seconds East 102.66 feet to a point at the lands now or formerly of Raymond E. and Genevieve A. Diehl; thence along lands of the Diehls South 05 degrees 35 minutes 22 seconds West 126.33 feet to a point at the corner of Lot 17 of the aforementioned Plan; thence South 60 degrees 37 minutes 02 seconds West 234.51 feet to Bellows Drive; thence along Bellows drive North 39 degrees 32 minutes 14 seconds West with a curve to the left with a radius of 225.00 feet and an arc length of 76.69 feet to a point, the place of BEGINNING.
