Church, Counsel for the Estate of Mary E. Burdge, deceased, anted
Lora A. Kulick, Senior Counsel for the Commonwealth of
Pennsylvania, Department of Revenue, and state:
WHEREAS, in August 2004, decedent and her three sons
established Burdge MoKan Partners, LP, a Missouri limited
partnership ("Partnership"); and
WHEREAS, the value of the Partnership was determined by
appraisal by Beard Miller Company, LLP, calculated with both a
minority aid lack of marketability discount; and
WHEREAS, the Department of Revenue assessed inheritance tax
on the transfer of the partnership assets after disallowing the
claimed valuation discounts; and
WHEREAS, the Estate filed a Petition for Appeal of this
assessment;
NOW THEREFORE, it is hereby stipulated between the parties
that:
1. The Department will issue a reassessment of inheritance
tax reflecting an $8,431.25 liability due by the Estate.
2. The Department and the Estate waive and abandon any
claim for further relief.
The Petition for Appeal shall be marked settled and closed,
and the Court of Common Pleas of Cumberland County is requested
to so Order.
