II. IDENTIFICATIONS AND DEFINITIONS A. I am a widower and I have no children. Except as otherwise provided in this my LAST WILL AND TESTAMENT, I have intentionally omitted to provide herein for any relatives or for any other person, whether claiming to be an heir or mine or not. B. The following definitions obtain in any other use of the terms of this will: 1. The persons who take this Will shall take by right of representation, in accordance with the rule of per capita distribution. Persons legally adopted when under the age of fourteen years shall not be differentiated from blood descendants for any purpose. 2. "Survive me" is to be construed to mean that the person referred to must survive me by thirty days. If the person referrcd to dies within thirty days of my death, the reference to him shall be construed as if he had failed to survive me. 3. As used in this Will, the words "Executor", "he", "him", "his" and the like shall be taken as generic and applicable to a natural person of either sex or a corporate person or other legal entity. C. I have served in the Armed Forces of the United States. Therefore, I direct my Executor to consult the legal assistance office at the nearest military installation to ascertain if there are any benefits to which my dependents are entitled by virtue of my military affiliation at the time of my death. Regardless of my military status at the time of my death, I direct my Executor to consult with the nearest Veterans Administration and Social Security Administration office to ascertain if there are any benefits to which my dependents may be entitled. III. PAYMENT OF DEBTS AND TAXES I direct my Executor to pay the following as soon after my death as may be practicable: 1. All of my just debts and the expenses of my last illness, funeral and of the administration of my estate; but my Executor need not accelerate and pay those unmatured obligations which, in his opinion, it might be proper and more advantageous to retain or renew any pay as they become due and payable. 2. All inheritance, transfer, estate and similaz taxes (including interest and penalties) assessed or payable by reason of my death, on any property or interest in my estate for the purpose of computing taxes. My executor shall not require any beneficiary under this will to reimburse my estate for taxes paid on property passing under the terms of this Will. IV. SPECIFIC BEQUESTS I give, devise and bequeath my property including real and personal property as follows: 1. To my friend, DANIELLE JEAN DERSIN, all personal effects owned by me at the time of my death, such as: my automobile, furniture, clothing, golf equipment, kitchenware, hand tools, and other items not heretofore enumerated either in my apartment or outside storage azea. 2. To my brother, J. EDWIN BARNITZ, the sum of Five Thousand Dollars ($5,000.00), provided he survives me by thirty (30) days. In the event he fails to survive me by thirty days, I give, devise and bequeath the sum of Five Thousand Dollars ($5,000.00) to be divided equally between two of his children, SUZANNE BARNITZ and JOSEPH BARNITZ.. 3. To my friend, DANIELLE JEAN DERSIN, I give, devise and bequeath the sum of Five Thousand Dollazs ($5,000.00), provided she survives me by thirty (30) days; 4. To my Niece, BARBARA K. CURRENCE, I give, devise and bequeath the sum of Three Thousand Dollars ($3,000.00); 5. To my Niece, SUZANNE B. NELSON, I give, devise and bequeath the sum of Three Thousand Dollars ($3,000.00); 6. To my Nephew, RICHARD A. KIME, I give, devise and bequeath the sum of Three Thousand Dollazs ($3,000.00); 7. To Sigma Alpha Epsilon (Fraternity), 1856 Sheridan Road, P.O. Box 1856, Evanston, Illinois, in memory of my father, George W. Barnitz, of the Pennsylvania Sigma Phi Chapter, the sum of One Thousand Dollars ($1,000.00); 8. To the First United Church of Christ of Carlisle, Pennsylvania, in trust, in memory of my wife, Mary Louise Barnitz, with the principal remaining intact and only the income therefrom being used for whatever purposes designated by the Governing Body of the Church Council, the sum of One Hundred Thousand Dollars ($100,000.00); 9. To the Forever Caring Fund, Church of God Home, Inc., Carlisle, Pennsylvania, the sum of One Hundred Thousand Dollars ($100,000.00), with principal remaining intact and only the income therefrom being used for whatever purposes designated by the Governing Body of the Church of God Home; 10. To the Dickinson College, Carlisle, Pennsylvania, in memory of my father and mother, George W. Barnitz and Marie Niesley Barnitz, the sum of One Hundred Thousand Dollars ($100,000.00) with principal remaining intact to be used for the endowment of a Scholazship Fund at the College by the Board of Trustees. The interest and earnings of said Fund shall benefit students of the College. No principal shall be expended from the Fund, in accord with a letter dated March 20, 1995 and a copy of which is attached hereto; V. RESIDUARY ESTATE A. I define "my Residuary Estate" as all of my property after the payment of debts and taxes under Article II, and after distribution of all Specific Bequests under Article III, including real and personal property, whenever acquired by me, property as to which effective disposition is not otherwise made in this Will, and property as to which I have an option to purchase or a reversionary interest. B. I give the remainder of my Residuary Estate to be divided as follows: 1. One-Third (1/3) unto the Forever Caring Fund, Church of God Home, Inc., Cazlisle, Pennsylvania, with the principal remaining intact and only the income therefrom being used for whatever purposes designated by the Governing Body of the Church of God Home; 2. One-Third (1/3)-unto the 1~` United Church of Christ, Carlisle, Pennsylvania, with the principal remaining intact and only the income therefrom being used for whatever purposes designated by the Governing Body of the 1 S` United Church of Christ, Carlisle; 3. One-Third (1/3) unto the Dickinson College of Carlisle, Pennsylvania, Endowment Scholarship Fund with the principal remaining intact and only the income therefrom being used for the benefit of the students, in accord with the Board of Trustees of Dickinson College. VI. APPOINTMENT AND POWERS OF EXECUTOR I hereby nominate, constitute and appoint DANIELLE JEAN DERSIN, as Executrix of this my Last Will and Testament. I request that my Executrix be permitted to serve without bond or surety thereon. I hereby relieve my Executrix from the necessity of posting security in connection with her duties, as such, in any jurisdiction in which she may be called upon to act insofar as I am able by law to do so. In addition to the powers conferred by law, I authorize my Executrix, in her absolute discretion, to retain in the form received, and to sell either at public or private sale any real or personal property owned by me at the time of my death. In the execution of her duties and powers as Executrix she shall have the power to comply with all legal formalities without the order of any court; and shall furnish a statement of receipts and disbursements at least annually to each person then entitled to receive income or property from my estate. I also direct that WILLIAM A. DUNCAN, ESQUIRE be employed as Attorney for my estate. VII. MEMORANDUM I have made, or may from time to time make, a written memorandum expressing my desire to give certain items of personal property to specific persons. I urge my Executrix and beneficiaries to respect these wishes. Such a memorandum, if made, shall be stored in conjunction with this Will.
