MUNICIPAL LIEN FOR SEWER SERVICES
North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of
Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its
claim for sewer services against the real estate hereinafter described and sets forth its claim as
follows:
STATEMENT OF CLAIM
The name of the municipality by which this claim is filed is North Middleton Authority, a municipal
authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and
organized pursuant to ordinances of North Middleton Township.

The name or names of owner or owners or reputed owner or owners of the property against which
this claim is filed is Richard Fortney, Jr., 231 A Longs Gap Road, Carlisle, PA 17015.
A description of the property against which this Lien is filed is attached hereto and marked as
Exhibit "A" with an address of 230 Wertz Run Road, Carlisle, PA 17013.

The authorities under and by virtue of which this Lien is filed is the Municipal Claims and Liens Act
of May 16, 1923, P.L. 207, as amended and supplemented, 53 P. S. 7101 et seq.

The lien is claimed for unpaid sewer user fees against the above-described property in the amount of
$298.46, plus any additional fees incurred thereafter.

Interest is claimed on the above-mentioned fees until paid in full.

hand paid, the receipt of which is hereby acknowledged, that said Grantors
do hereby grant and convey to the said Grantee,
ALL THAT CERTAIN tract of land situate in North Middleton
Township, Cumberland County, Pennsylvania, bounded and described
in accordance with the Preliminary/f=inal Subdivision Plan for Robert L.
Noll and Mary E. Noll recorded in the hereinafter mentioned Recorder's
Office in Plan Book 74, Page 16, as follows:
BEGINNING at an existing P.K. nail in the centerline of the Cartway
of 60 feet wide Township Road T-499, known as Wertz Run Road at
the corner of lands now or formerly of Robert L. and Gloria M. Jumper;
thence along the centerline of the Cartway of Township Road T-499,
known as Wertz Run Road, South 59 degrees 25 minutes 00 seconds
East a distance of 94.71 feet to a point in line of Lot No. 2 as shown on

the aforementioned Subdivision Plan; thence along said Lot No. 2
South 29 degrees 25 minutes 56 seconds West a distance of 177.10
feet to an iron pin set; thence by same North 60 degrees 34 minutes
04 seconds West a distance of 127.22 feet to an iron pin set in line of
land now or formerly of Robert L. and Gloria M. Jumper; thence along
said lands now or formerly of Robert L. and Gloria M. Jumper North 39
degrees 44 minutes 00 seconds East a distance of 181.94 feet to an
existing P.K. nail in the centerline of the Cartway of Township Road T-
499, known as Wertz Run Road, the Place of BEGINNING.
CONTAINING 19,771.27 square feet, 17,037.35 square feet of the
dedicated right of way for Township Road T-499, known as Wertz Run
Road, and being all of Lot No., 1! as shown on the Preliminary/Final
Subdivision Plan for Robert L. Noll and Mary E. Noll recorded in the
hereinafter mentioned Recorder's Office in Plan Book 74, Page 16.
UNDER AND SUBJECT to all easements, reservations, restrictions,
and rights of way of record.
BEING the same premises which Randy D. Pentz by Deed dated May
17, 2002, and recorded in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania in Book 251, Page 4094, conveyed
unto Matthew R. Black and Kerry P. Black, husband and wife, Grantors
herein.
TOGETHER with all and singular the buildings, Improvements, ways,
woods, waters, watercourses, rights, liberties, privileges, hereditaments and
appurtenances to the same belonging or in anywise appertaining; and the
reversion and reversions, remainder and remainders, rents, issues and
profits thereof, and of every part and parcel thereof; AND ALSO all the
estate, right, title, interest, use, possession, property, claim and demand
whatsoever of the Grantors both in law and in equity, of, in and to the
premises herein described and every `part and parcel thereof with the
appurtenances. TO HAVE AND TO HOLD all and singular the premises
herein described together with the hereditaments and appurtenances unto
the Grantors and to the Grantee's proper use and benefit forever.
AND the Grantors covenant that, except as may be herein set forth
they do and will forever and specially warrant and defend the lands and
premises, hereditaments and appurtenances hereby conveyed, against the
Grantors and all other persons lawfully claiming the same or to claim the
same or any part thereof, by, from or under it, him or any of them.
