Plaintiffs Stanley Bennett and Christina Bennett are adult individuals residing at 123 Silver Drive, Elizabethtown, Lancaster County, Pennsylvania 17022. 2. Defendant Laquiluia Thomas is an adult individual residing at 300 Harvest Lane, Shippensburg, Cumberland County, Pennsylvania 17257. 3. On or about February 18, 2009, Plaintiff Stanley Bennett was operating the 2003 Chevy Tahoe owned by Plaintiff and was preparing to get on Route 81 North at the Old Scotland Road on-ramp. 4. At that time, a vehicle operated by Defendant Laquiluia Thomas lost control causing it to spin out of control and strike the Plaintiffs' vehicle. 5. As a direct and proximate result of the accident, Plaintiffs' vehicle sustained property damage in the amount of $6,140.96. (A true and correct copy of the Estimate of Damages is hereby attached as Exhibit "A.") 6. As a direct and proximate result of the damage to Plaintiffs' vehicle, Plaintiffs incurred rental expenses of $617.48. (A true and correct copy of the Rental Invoice is hereby attached as Exhibit "B.") 7. As a result of the accident, Plaintiffs have incurred damages totaling $6,758.44. ($6,140.096 + $617.48 = $6,758.44.) COUNTI Stanley and Christina Bennett v. Laquiluia Thomas 8. The averments of paragraphs 1 through 7 are hereby incorporated by reference. 9. The accident or collision was caused solely as a result of the negligence, recklessness, and carelessness of the Defendant Laquiluia Thomas in that she: a. failed to maintain control of her vehicle; b. was driving too fast for the conditions then and there existing on the roadway; C. failed to operate her vehicle in a way to avoid striking Plaintiffs' vehicle; and d. failed to properly brake her vehicle.
